NOTICE OF APPLICATION FOR THE GRANT OF A LICENCE FOR PREMISES IN WHICH THE BUSINESS CARRIED ON UNDER THE LICENCE IS THE BUSINESS OF THE SALE OF INTOXICATING LIQUOR BY RETAIL FOR CONSUMPTION OFF THE PREMISES

IN THE COUNTY COURT FOR NORTHERN IRELAND SITTING AT ENNISKILLEN COURTHOUSE

TAKE NOTICE that Frazer One Stop Shop Limited having its registered office at 2 Main Street, Maguiresbridge, Co Fermanagh BT94 4PH intend to apply to the County Court Sitting at The Courthouse, East Bridge Street, Enniskillen, Co Fermanagh BT74 7BW commencing at 10.30am on the forenoon of the 8th day of January 2019 for the grant of a Licence for the premises situate at 52 Gardiners Road, Killashanbally, Maguiresbridge, Co Fermanagh BT94 4RY being such premises as are specified in Article 5 (i) (b) of the Licensing (Northern Ireland) Order and the Licensing (Conditions for Mixed Trading) Regulations (Northern Ireland) 1997 namely premises in which the Applicant intends to carry on the business of selling intoxicating liquor for consumption off the premises.

AND TAKE NOTICE that this application be dealt with by the Court on the 8th day of January 2019 commencing at 10.30am in the forenoon.

Frazer One Stop Shop Limited will be the owner of the business whose Director is:-

Janice Smyton, 56 Tullyhill Road, Maguiresbridge, County Fermanagh BT94 4PH.

The above named Director has executive control of the Company.

The owner of the premises is Frazer One Stop Shop Limited.

In accordance with Schedule 1 of the said Order and Rule 6 of Order 48 of County Court Rules (Northern Ireland) 1981 attached to this Notice is a copy of the plan of the said premises delineating: -

(a) the part or part thereof in which intoxicating liquor is to be sold;



(b) the specified area (s) in which intoxicating liquor will be available for purchase and its point of sale.



There is in force Planning Permission to use the premises as premises of the kind specified in this Notice for the period during which the Licence would be in force and a copy of the Planning Permission is attached.

A subsisting Licence as defined in Schedule 2 of the said Order for the premises such as are specified in Article (5)(i)(a) situated at the Coach Inn, Main Street, Maguiresbridge, Co Fermanagh BT74 7BW will be surrendered to the Court.

AND FURTHER TAKE NOTICE that any person owning, residing or carrying on business in premises in the vicinity of the premises for which the Licence is sought must in accordance with Paragraph 6 of Schedule 1 to the Order serve notice of his intention to object upon the Applicant Company at either the applicants address or at the address of the Solicitors for the applicant set out below and the Chief Clerk not less than one week before the opening of the Court Sitting specified herein.

The permissible grounds of objection are such as are specified in Article 7 (4) (a) to (e) (i) of the Licensing Order, namely: -

(i) Failure to comply with the correct procedure;



(ii) unfitness of the applicant;



(Mi) unsuitability of the premises and;

(iv) where subject to Article 7 (6) of Schedule 3, paragraph 6 of the said Order, the number of licenced premises of that kind in the vicinity is or will be adequate.
