PROPOSED TRAFFIC REGULATION ORDER

WEST BERKSHIRE DISTRICT COUNCIL (PROHIBITION AND RESTRICTION OF WAITING AND LOADING, PARKING PLACES AND RESIDENTS' PARKING (CONSOLIDATION) ORDER 2009 (AMENDMENT NO 28) ORDER 201[]

STATEMENT OF REASONS AND PROPOSAL

This Order is proposed to improve road safety at identified problem locations, will address obstruction concerns related to inconsiderate parking along the route of the A4 Thatcham-Newbury cycleway and will resolve issues related to resident parking, together with the management of parking on highways in various locations across the District WEST BERKSHIRE DISTRICT COUNCIL PROPOSES to make an order under Sections 1(1), 2(1) to (3), 3(2) and 4(2), 19, 32, 35, 45, 46, 47, 49, 53 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 ("the Act") and all relevant powers under Part 6 of the Traffic Management Act 2004 the effect of which is to

PLANS

The Order will amend Schedule 2 to the Consolidation Order 2009 by the addition of the following Plans: AO73

The Order will amend Schedule 2 to the Consolidation Order 2009 by the revision of the following Plans:

L69, L70, M69, AI84, AJ70, AK75, AK77, AL73, AL74, AM73, AM74, AM75, AM76, AN72, AN74, AO72, AS72, AT72, AU72, AU73, AW73, AX73, BN27, BS36, BS37, BT38, BW84, BX55 and BZ37

This Order will amend Schedule 2 to the Consolidation Order 2009 by the deletion of the following Plan: BW58

Under Part III of the 2009 Order add the additional Clause:-

"19. The Council may at its discretion decide that where no valid pay & display ticket

can be obtained from a ticket machine within a pay & display by phone area vehicles

may be parked in the parking place but payment of the appropriate charge must be

made using an alternative approved method of payment"

This Order will amend Schedule 3 to the Consolidation Order 2009 by the deletion

of the column "Method of Payment" to the tariff table

This Order will amend the following Articles to the Principal Order with the inclusion of the following wording:

Article 2 "pay and display area" definition should read "means a parking place identified on the plans as pay & display "or pay by phone" and for which a specified charge for parking is payable as "listed in Schedule 3" "pay by phone" to include the words "as listed in Schedule 3 and" between "parking charges" and "as directed"

"specified charge for parking" to include the words "or pay by phone" after "pay and display and "as listed in Schedule 3" after the word "area" Article 10(2) is hereby amended by the inclusion of the words "and as listed in Schedule 3" after the words "notices on site"

Article 12(1) is hereby amended by the inclusion of the words "as listed in Schedule 3"

after the words "in the parking place"

REVOCATIONS

This Order will revoke the following Order ONLY insofar as it relates to the changes indicated in the Plan Schedule to this Order: West Berkshire District Council (Prohibition and Restriction of Waiting and Loading, Parking and Residents' Parking Places) (Consolidation) Order 2009 and in Amendment No 18 clause 42 will be revoked in its entirety.
