Notice of Confirmation of a Public Path Diversion and Definitive Map and Statement Modification Order
Highways Act 1980 Wildlife and Countryside Act 1981 Dorset County Council (Parts of Footpath 18 and 19, Lyme Regis at Haye Farm) Public Path Diversion Order 2017.
On 21 March 2018 Dorset County Council confirmed the above named order made under Section 119 of the Highways Act 1980 as unopposed and the County Council has certified that work has been carried out to bring the site of the new highway mentioned in article 3 of the order into a fit condition for use by the public. The effect of the order as confirmed is to divert the public footpaths in the parish of Lyme Regis in the West Dorset District as shown on the order map as follows:-From the existing paths:
Part of Footpath 18, Lyme Regis in the West Dorset District:
From the unaffected part of Footpath 18, south east of Haye Farm at SY 33349299,
north north west along the driveway to Haye Farm to its junction with the current
route of Footpath 19, east of the farmyard at SY 33329302. (No recorded width).
Part of Footpath 19, Lyme Regis in the West Dorset District:
From the unaffected part of Footpath 19, east south east of Haye Farm at
SY 33379300, west north west across a field to its junction with the current route
of Footpath 18, east of the farmyard at SY 33329302. Continue west north west,
passing to the north of Haye Farm and through a garden area next to holiday
cottages, to its junction with Footpath 20 at SY 33229309. (No recorded width).
To the new paths:
Part of Footpath 18, Lyme Regis in the West Dorset District: (To be renumbered as part of Footpath 19) to form a continuous path.
From the unaffected part of Footpath 18, south east of Haye Farm at SY 33349299, generally east north east across a field to its junction with Footpath 19, east south east of Haye Farm at SY 33379300. The width of this part of Footpath 18 is 2 metres. Part of Footpath 19, Lyme Regis in the West Dorset District:
From its junction with Footpath 18, south east of Haye Farm at SY 33349299, west north west through a field, passing to the south of Haye Farm buildings, to the field boundary at SY 33269302. Continue west and north west across a field, passing to the west of holiday cottages, to its junction with Footpath 20 at SY 33219307. The width of this part of Footpath 19 is 2 metres.
A copy of the order as confirmed and the order map have been placed and may be seen free of charge at Reception, County Hall, Colliton Park, Dorchester during normal office hours. The order comes into force on 28 March 2018 but if any person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 3 May 2018, make an application to the High
Court.
