The Stopping Up of Highways (London Borough of Sutton) (Land at Pedestrian Precinct, Wallington Square, Wallington) Order 2018
NOTICE IS HEREBY GIVEN that the Council of the London Borough of Sutton of Civic Offices, St. Nicholas Way, Sutton SN1 1EA (the "Council") has made an order pursuant to section 247 of the Town and Country Planning Act 1990 (the "Act") in respect of highway in fifteen locations outside units 7, 8, 9, 10, 14A, 15, 16, 17, 19, 20, 30, 32, 33, 35, 36, 37, 39 and 40 in the Pedestrian Precinct, Wallington Square, Wallington SM6 8RG each measuring 2 metres in length and 2 metres in width, all such land being in the London Borough of Sutton.
The effect of the Order is that the said land has ceased to be public highway.
The Council is satisfied that it is necessary to stop up the parts of the Pedestrian Precinct, Wallington Square, Wallington SM6 8RG which are the subject of this Order, to allow the implementation of a planning permission granted by the Council on 12 February 2015 (under reference number D2014/70773) for the carrying out of development authorised by a previous planning permission granted under reference D2014/69442 without complying with certain conditions and subject to the variation of certain plans (which previous planning permission was in turn a planning permission for the carrying out of development authorised by an earlier planning permission granted under reference D2013/67339 without complying with certain conditions and subject to the variation of certain plans); which development, in summary, comprises the demolition of nos. 13-21 Wallington Square and 26 Clarendon Road; the erection of a phased development of two A1 retail units, one A1/A3 unit and an extension to the ground floor retail unit at the north east corner of the site; the erection of 14 one bedroom and 16 two bedroom self-contained flats, in 2 three storey blocks above the redeveloped units, including the provision of communal amenity space at first floor level; provision of parking spaces; service road, to include loading bays; cycle parking spaces, refuse storage facilities, and provision of a canopy structure to cover the existing shopping mall; together with associated works.
A copy of the Order and a map defining the land to which the Order relates can be inspected at the Council's Civic Offices at all reasonable hours.
Any person aggrieved by the Order and desiring to question the validity thereof, or any provision contained therein, on the ground that it is not within the powers of the Act or that any requirement of the Act or of any regulation made thereunder has not been complied with in relation to the Order, may within six weeks of 22 March 2018 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
