PROHIBITION OF HEAVY COMMERCIAL VEHICLES
(NORTON-ON-DERWENT LEVEL CROSSING) EXPERIMENTAL ORDER 2018
NOTICE is hereby given that on 09/02/18 North Yorkshire County Council made an Order under Sections 9 and 10 of the Road Traffic Regulation Act 1984, the effect of which is to prohibit any heavy commercial vehicle (i.e. any goods vehicle which has an operating weight exceeding 7.5 tonnes) from driving along so much of the B1248, Castlegate as passes over Norton-on-Derwent Level Crossing (between Malton and Norton) for an experimental period of eighteen months, except for certain permitted purposes (including exemptions for permit holders).
A copy of the Order, which comes into operation on 26/02/18, together with a map showing the road affected and a statement of the Council's reasons for making the Order may be inspected at County Hall, Northallerton; at Malton Library, St Michael Street, Malton, North Yorkshire YO17 7LJ and at Norton Hive Library, 86 Commercial Street, Norton, Malton, North Yorkshire YO17 9ES during normal office hours from 14/02/18 until 26/08/18 and also viewed online at www.northyorks.gov.uk/notices. The County Council will be considering, in due course, whether the provisions of the Order should be continued in force indefinitely. Within a period of six months from the coming into force of the Order, or if the Order is subsequently varied or modified, from the coming into operation of that variation or modification (whichever is the later), any person may object to the making of an Order for the purposes of such indefinite continuation. Any person wishing to object to the indefinite continuation of the Order must state the grounds for their objection, in writing, addressed to "Area 4 Kirby Misperton Highways Office, Beansheaf Industrial Park, Tofts Road, Kirby Misperton, Malton, North Yorkshire YO17 6BG" or by e-mail to area4.kirbymisperton@northyorks.gov.uk or via the website link above by 26/08/18.
If any person wishes to question the validity of the above Experimental Order or of any provision contained in it, on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or on the grounds that any requirement of that Act, or of any instrument made under it, has not been complied with in relation to the Order, they may, within six months of 09/02/18 make application to the High Court for that purpose.
