In respect of an Initial Demolition Notice TAKE NOTICE: Intention to Demolish
We, Westlea Housing Association, hereby give you formal notice pursuant to paragraphs 2(2) 13 of Schedule 5 to the Act of our Intention to Demolish 1, 2, 3, 4, 5, 6, 9, 10, 11, 12, 13 and 14 Bendy Bow, Oaksey, Wiltshire, SN16 9TN ("the Premises").
Reasons for Demolition
We intend to demolish the Premises because we intend to redevelop the area. Proposed Demolition Date
We intend to demolish the Premises by no later than 24 August 2024. Operation and expiry of the Initial Demolition Notice
This notice will remain in force until 24 August 2024, unless revoked or otherwise terminated under or by virtue of paragraph 3 of Schedule 5A of the Housing Act 1985 or extended.
Effects of this Notice
Whilst the Notice is in force Westlea Housing Association will not be under an obligation to make such a grant as is mentioned in Section 138(1) of the Housing Act 1985 in respect of any claim to exercise the right to buy in respect of any of the Relevant Premises.
This Notice does not prevent the making of a claim under the right to buy or the taking of any steps under this part in connection with any such claim up to the point where section 138(1) would otherwise operate in relation to the claim or the operation of that provision in most circumstances where the notice ceases to be in force. However, if we subsequently serve a final demolition notice in respect of the Relevant Premises, the right to buy will not arise in respect of it while that notice is in force and any existing claim will ceased to be effective.
Right to Compensation
The Housing Act 1985, Section 138 confers a right to compensation in respect of certain expenditure. This means that Section 138 of the Act confers on you a right to compensation in respect of legal and other fees and other professional costs and expenses paid by you in connection with the exercise by you of the preserved right to buy.
