LICENSING (NORTHERN IRELAND) ORDER 1996 (Article 23)
Notice of Application for the transfer and renewal of a Licence. Petty Sessions District of Fermanagh. County Court Division of Fermanagh and Tyrone
TAKE NOTICE that I Rory Foy of 50 Clarnagh Road, Tempo in the County of Fermanagh intend at the Magistrates Court sitting at Enniskillen on the 13th day of September 2017 at 10am to apply for the transfer to me of a Licence at present held by James Foy of 54 Creagh Road, Tempo aforesaid for the premises situate at and known as The Milltown Manor, 61 Main Street, Tempo aforesaid being premises of the following kind according to the Licensing (Northern Ireland) Order 1996, namely premises specified in Article 5(1)(a) premises in which the only or principal business carried on is the business of selling intoxicating liquor by consumption either in or off the premises; that I  of 50 Clarnagh Road, Tempo in the County of Fermanagh intend at the Magistrates Court sitting at Enniskillen on the 13th day of September 2017 at 10am to apply for the transfer to me of a Licence at present held by James Foy of 54 Creagh Road, Tempo aforesaid for the premises situate at and known as The Milltown Manor, 61 Main Street, Tempo aforesaid being premises of the following kind according to the Licensing (Northern Ireland) Order 1996, namely premises specified in Article 5(1)(a) premises in which the only or principal business carried on is the business of selling intoxicating liquor by consumption either in or off the premises;

A Protection Order authorising the said Rory Foy to carry on business under the Licence was granted on 7th June 2017 by the Magistrates Court sitting at Enniskillen on 7th June 2017 for the period of six months fromthedateoftheOrder. I am the owner of the business carried on under the Licence. The owner of the premises is the said James Foy of 54 Creagh Road, Tempo aforesaid. No alteration such as is specified in Article 31 of the Licensing (Northern Ireland) Order 1996 has been made to the premises since the Licence was last renewed.

As the existing Licence is due to expire on 30th September 2017 TAKE NOTICE that at the same time I intend to apply to the Court to renew the Licence until the expiration of the next licencing period i.e. 30th September 2022 before transferring it to me.

TAKE NOTICE  The Licence will be deposited with the Clerk of Petty Sessions before or at the hearing of the Application. FURTHER TAKE NOTICE that any person owning or residing or carrying on business in premises in the vicinityofthepremises for which the renewal and transfer of the Licence is sought who intends to object must in accordance with paragraph 6 of Schedule4 ofthe said Order serve Notice of Intention to Object briefly stating his grounds for so doing upon the Applicant and the Chief Clerk not less than one week before the hearing of the Court application. AND FURTHER TAKE NOTICE that the permissible grounds of objection are specified in Article 15(2) of the said Order namely fitness of the applicant, unsuitability of the premises and/or failure to comply with the Statutory Procedure.
