PLANNING AND COMPULSORY PURCHASE ACT 2004 (AS AMENDED) THE TOWN AND COUNTRY PLANNING (LOCAL PLANNING) (ENGLAND) REGULATIONS 2012 ENVIRONMENTAL ASSESSMENT OF PLANS AND PROGRAMMES REGULATIONS 2004 ST.HELENS LOCAL PLAN BOLD FOREST PARK AREA ACTION PLAN ADOPTION STATEMENT
Notice is hereby given, in accordance with Regulations 17 and 26 of the Town and Country Planning (Local Planning) (England) Regulations 2012, and Regulation 16 of the Environmental Assessment of Plans and Programmes Regulations 2004, that St.Helens Council resolved to adopt the Bold Forest Park Area Action Plan on 12th July 2017. Forming part of the St.Helens Local Plan, the Bold Forest Park Area Action Plan is a statutory document which sets out the detailed policies and actions required to develop Bold Forest Park. Following examination by an independent Planning Inspector appointed by the Secretary of State, a number of ‘main’ modifications were made to the submitted Area Action Plan Publication document (November 2015), as set out in the Appendix to the Inspector’s Report. Pursuant of section 23(3) of the Planning and Compulsory Purchase Act 2004, the adopted Area Action Plan incorporates these modifications along with additional ‘minor’ modifications made by the Council. Any person aggrieved by the Area Action Plan may make an application to the High Court under Section 113 of the Planning and Compulsory Purchase Act 2004 on the grounds that the document is not within the appropriate powers or that a procedural requirement has not been complied with. Any application must be made no later than the end of the period of six weeks starting on the date of adoption by the Council, i.e. no later than Tuesday 22nd August 2017.
