TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997 THE EAST LOTHIAN COUNCIL REVOCATION OF PLANNING PERMISSION ORDER NO PR-022017
The East Lothian Council Revocation of Planning Permission Order No PR-022017 is pursuant to Planning Application number 16/00530/P (“Planning Application”) for changes to Planning Permission 10/00203/P in respect of permission to carry out alterations to 1 house to form 1 house and 2 flats, the erection of 7 houses, erection of garages and a car port and associated works (“the Development”) at the subjects being the subjects known as and forming ALL and WHOLE Drummohr House, Musselburgh, East Lothian being part and portion of the subjects with garden ground and indoor Riding School, stables, warehousing, stores and others erected thereon which subjects are registered in the Land Register of Scotland under Title Number ELN17085 (“the Planning Subjects”).
TAKE NOTICE that East Lothian Council, constituted under the Local Government (Scotland) Act 1994 and having its principal office at John Muir House, Haddington (hereinafter referred to as “the Council”) have made an Order under Sections 65 and 67 of the Town and Country Planning (Scotland) Act 1997 as follows:
1. That the Planning Permission granted for the Development at the Planning Subjects and being the subject of and pursuant to Planning Permission 10/00203/P approving the Development is HEREBY REVOKED IN PART but only in so far as the Planning Permission 10/00203/P applies only to the house on plot B2 of the Planning Subjects as shown delineated and cross hatched in dark blue on the Plan annexed and signed as relative to this Order (“the Plot B2 Unit”) and subject to the following conditions:
1.1 Notwithstanding the foregoing revocation contained herein in paragraph 1, the Planning Permission 10/00203/P and all amendments thereto granted subsequent to the date of Planning Permission 10/00203/P and prior to the date of the said East Lothian Council Revocation of Planning Permission Order No PR-022017 shall continue to have full force and effect in respect of the Planning Subjects excluding the Plot B2 Unit; and
1.2 The Planning Permission shall cease to have effect in respect of the Plot B2 Unit on the date that this Order takes effect. The Council have been notified in writing by the owners and occupiers of the Land that they do not object to the Order. The Council is not of the opinion that any other person will be affected by the order.
Copies of the Order, together with the Plan referred to therein may be inspected by any person, free of charge at Environment Reception, John Muir House, Haddington and Musselburgh Library, 10 Bridge Street, Musselburgh, East Lothian, EH21 6AG, East Lothian during opening hours. If you will be affected by the Order and wish for an opportunity of appearing before, and being heard by, a person appointed by Scottish Ministers you should give notice to that effect to The Scottish Ministers, Victoria Quay, Edinburgh, EH6 6QQ, not later than 28 days from the date of this Notice being the 10th August 2017. If no such notice has been given by that date, the Order will take effect, by virtue of the provisions of Section 67 of the Town and Country Planning (Scotland) Act 1997 14 days following, being the 24th August 2017.
