NOTICE UNDER ARTICLE 9 OF APPLICATION FOR PLANNING PERMISSION

Take notice that application is being made by: West Quay Development Co Partnership LLP

To Brighton and Hove City Council City Council for an application for a non-material amendment to the wording of condition 12 attached to planning permission ref. BH/2015/04435 to read as follows:

"Within 6 months of commencement of each phase above podium level, details of a Waste Storage and Collection Strategy for the residential and retail/commercial units of Phase 1 (as set out in the Phasing Plan agreed by condition 2) shall be submitted to the Local Planning Authority for approval. The Strategy shall include details of the following: access arrangements, including measures to ensure communal refuse is placed at agreed collection points that can be accessed by council vehicles; types and sizes of containers and frequency of collection.

The agreed Waste Storage and Collection Strategy for each respective phase of the development (as set out in the Phasing Plan agreed by condition 2) shall thereafter be implemented unless otherwise agreed in writing by the Local Planning Authority."

Any owner of the land or tenant who wishes to make representations about this application, should write to Development Control Team, City Services Directorate, Brighton & Hove City Council, Town Hall, Norton Road, Hove BN3 3BQ within 21 days of the date of this notice.

Statement of owners' rights: The grant of planning permission does not affect owners' rights to retain or dispose of their property, unless there is some provision to the contrary in an agreement or lease.

Statement of agricultural tenants' rights: The grant of planning permission for non-agricultural development may affect agricultural tenants' security of tenure.

'Owner' means a person having a freehold interest or a leasehold interest the unexpired term of which is not less than seven years. 'Tenant' means a tenant of an agricultural holding any part of which is comprised in the land.
