NOTICE OF COMPULSORY ACQUISITION UNDER SECTION 134 OF THE PLANNING ACT 2008 M4 (JUNCTIONS 3 TO 12) (SMART MOTORWAY) SCHEME DEVELOPMENT CONSENT ORDER 2016 ("ORDER")

NOTICE OF AUTHORISATION OF COMPULSORYACQUISITION

The above Order made under the Planning Act 2008 by the Secretary of State for Transport and published on 2 September 2016 includes provision authorising the compulsory acquisition of land, of existing rights over land, and of rights over land by creating new rights over it, as described in the Schedule.

This Order includes provision authorising the acquisition for the purpose of the M4 Junctions 3 to 12 Smart Motorway Scheme (the "Scheme") in the South East of England region. The length of the Scheme is approximately 52 kilometres and is situated in the London Boroughs of Hounslow and Hillingdon, Counties of West Berkshire, Buckinghamshire and South Buckinghamshire, the Royal Borough of Windsor and Maidenhead and the Boroughs of Bracknell, Wokingham, Slough and Reading.

The main aspects of the Scheme are:

1. conversion of the hard shoulder to a running lane ("all lane running");



2. widening or demolition and rebuilding of existing overbridges, underbridges, subways and culverts;



3. widening and realignment of the M4 Motorway and side roads;



4. installation and removal of signs and/or gantries with associated cabinets and cabling;



5. installation of above ground traffic detection radar units and closed circuit television cameras;



6. construction of Emergency Refuge Areas ("ERAs");



7. the compulsory acquisition of land including rights in or over land required for the purposes of the Scheme, or to facilitate or incidental to the Scheme;



8. imposition of variable speed limits and other traffic management and control measures; and



9. development including plant, equipment and buildings comprised in the Scheme including:



9.1 construction sites, lay-down areas, working areas and temporary works and structures;



9.2 site access, internal site roads and vehicle parking;



9.3 landscaping and replacement planting;



9.4 foul drainage provision and surface water management systems;



9.5 permanent and/or temporary changes to the highway network for the Scheme and other access facilities;



9.6 the application and/or disapplication of legislation relevant to the Scheme including inter alia legislation relating to the compulsory acquisition of land and traffic management; and



9.7 such ancillary, incidental and consequential provisions, permits or consents as are necessary and/or convenient.

ApersonaggrievedbytheOrdermaychallengetheOrderonlyinaccordancewith section118ofthePlanningAct2008, which stipulates that any proceeding must be brought by filing a claim form for judicial review before the end of the period of | 6 weeks beginning with the day after the day on which the Order was published (or, if later, the day on which the statement of reasons for making the Order is published).

SCHEDULE

DESCRIPTION OF THE LAND, EXISTING RIGHTS AND THE NEW RIGHTS

The Order land (as defined in article 2 of the M4 (Junctions 3 to 12) (Smart Motorway) Scheme Development Consent Order | 2016 ("Order")) is shown on the land plans and a short textual description of each numbered plot is included in the Book of Reference for the Scheme. This notice relates to so much of the Order land as is shown shaded pink, shaded grey and shaded blue on the land plans.

TheSchemeislocatedbetweenjunction3and12oftheM4Motorway,isapproximately52kilometresandissituatedinthe London Boroughs of Hounslow and Hillingdon, Counties of West Berkshire, Buckinghamshire and South Buckinghamshire, the Royal Borough of Windsor and Maidenhead and the Boroughs of Bracknell, Wokingham, Slough and Reading.

Highways England may acquire:

(a) so much of the Order Land as is specified by article 20 (compulsory acquisition of land) of the Order for the authorised development, or to facilitate it, or as is incidental to it;



(b) such rights over the Order land, by creating them as well as by acquiring rights already in existence, as is authorised by article 22 (compulsory acquisition of rights) of the Order;



(c) in the case of the Order land specified in column (1) of Schedule 5 of the Order (land in which only new rights etc., may be acquired) Highways England's powers of compulsory acquisition are limited to the acquisition of such wayleaves, easements and new rights in the land
