Initial Demolition Notice
that the landlord intends to demolish the dwelling within a specified period of not more than seven years

Section 138A and Schedule 5A of the Housing Act 1985 as amended THIS NOTICE
is given by the MAYOR AND BURGESSES OF THE LONDON BOROUGH OF BRENT OF CIVIC CENTRE, ENGINEERS WAY, WEMBLEY, MIDDLESEX HA9 OFJ ("the Council").
1. The Council intends to redevelop and demolish the dwellings, including your own, and the buildings containing them (the Relevant Properties) set out below:

* John Ratcliffe House, London, NW6 5LH;

* Blake Court, Malvern Road, London, NW6 5PW;

* Dickens House, London, NW6 5YR;

* Zangwill House, Carlton Vale, London, NW6 5BY; and

* Crone Court, Denmark Road, London, NW6 5BU

2. The purpose of the demolition is to re-develop John Ratcliffe House, Blake Court, Dickens House, Zangwill House and Crone Court to provide new flats:

a. The proposed redevelopment of John Ratcliffe House will provide approximately 35 new dwellings as part of a mixed tenure housing development.

b. Blake Court will form part of a development site with Austen House, Cambridge Road, Kilburn, London NW6 5YL to provide approximately 220 flats. The proposed re-development of Austen House and Blake Court is a mixed tenure housing development with the intention to incorporate and re-provide the Marian Community Centre and Immaculate Heart of Mary Catholic Church.

c. Dickens House, which is part of a mixed-use development with active ground floor uses (subject to viability) which will deliver approximately 131 dwellings.

d. Zangwill House and Crone Court will form part of a development site with Craik Court, Carlton Vale, Kilburn, London NW6 5HL to provide approximately 265 flats. The proposed re-development of Craik Court, Crone Court and Zangwill House is a mixed tenure housing development with potential for ground floor commercial uses.

3. The redevelopment forms part of the Council's approach to deliver 2,400 new high-quality homes over the 15-year programme.

4. The Council intends to demolish the Relevant Properties before

a. 31st March 2029 in respect of John Ratcliffe

b. 31 June 2025 in respect of Blake Court

c. 31 January 2029 in respect of Dickens House

d. 31 December 2027 in respect of Zangwill House

e. 31 June 2027 in respect of Crone Court

5. This Notice has been served on the tenants at Relevant Properties. It will remain in force up to and including:

a. 31st March 2029 in respect of John Ratcliffe

b. 31 June 2025 in respect of Blake Court

c. 31 January 2029 in respect of Dickens House

d. 31 December 2027 in respect of Zangwill House

e. 31 June 2027 in respect of Crone Court

unless extended, revoked or otherwise terminated under or by virtue of paragraph 3 of Schedule 5A of the Housing Act 1985.

6. Whilst this Notice is in force the Council will not be under an obligation to make such a grant as is mentioned in section 138(1) of the Housing Act 1985 in respect of any claim by a tenant to exercise the right to buy in respect of any of the Relevant Properties.

7. Right to Buy claims submitted to the Council for any of the Relevant Properties whilst this Notice is still in force will be processed by the Council as normal, so that if the demolition plans are not implemented the application can be completed.

8. Where this Initial Demolition Notice has been served upon a secure tenant with an existing claim to exercise Right to Buy in respect of any of the Relevant Properties there may be a right to compensation under Section 138C of the Housing Act 1985 in respect of certain expenditure incurred in relation to an existing Right to Buy claim

9. Any claim for compensation under the previous paragraph of this Notice should be served upon the Council within the period of three (3) months beginning from the operative date of this notice. Compensation under section 138C is compensation in respect of expenditure reasonably incurred by the tenant before the operative date in respect of legal and other fees, and other professional costs and expenses, payable in connection with the exercise of that Right to Buy claim.

10. If the Council serves a Final Demolition Notice in respect of the Relevant Properties and a right to buy application is suspended due to the service of this Notice, that application will lapse and no further application can then be made whilst the Final Demolition Notice is in effect.

11. The operative date of this Notice is 12th January 2022 which is the date a copy of this Notice was served on the tenants and occupiers.
