Town and Country Planning Act 1990 (TCPA 1990) Notice of a stopping up order made at 8-25 Beech Tree Place and 29-35 West Street Sutton

1. The Council of the London Borough of Sutton (Council) gives notice that it has made an order under section 247 of the TCPA 1990 authorising the stopping up of an area of highway at Beech Tree Place and St Nicholas Way with a total area of approximately 734.1223m2 shown hatched heavy black on the plan attached to the order (Plan).

2. The order is made to enable the development described in the Schedule to be carried out in accordance with the planning permission granted under Part III of the TCPA 1990 to the London Borough of Sutton by the Council on 24 June 2022 under reference DM2021/02331.

3. A copy of the order and Plan (reference Stopping Up Order No. 1 2022) may be inspected free of charge at the Council Offices at Civic Offices, St. Nicholas Way, Sutton SM1 1EA between the hours of 9am to 5pm Monday to Friday (excluding bank holidays and public holidays).

4. The order comes into force on 22nd December 2022.

5. Any person aggrieved by the order and wishing to question its validity, or any provision contained in the order, on the ground that it is not within the powers of the TCPA 1990 or that any procedural requirement of the TCPA 1990 or any regulation made under the TCPA 1990 has not been complied with in relation to the making of the order may, within 6 weeks following 22nd December 2022 apply to the High Court for the suspension or quashing of the order or of any provision contained in the order.
