Town And Country Planning Act 1990 Section 257 Notice Of Application For A Diversion Of A Section Of Public Footpath No.214 At Elephant Lane To Thatto Heath Park, St Helens

St Helens Borough Council is the Highway Authority for the Public Footpath in question and is the authority by whom applications under Section 257 Town and Country Planning Act 1990 ('the Act') for the diversion of the Public Footpath may be made.

Under the Town and Country Planning Act 1990 the Council is empowered to make Order to divert or stop-up public paths to enable development to be carried out in accordance with planning permission granted by the Council or the Secretary of State for Environment, Food and Rural Affairs. The proposals are more particularly specified in the Schedule to this notice.

Any person to whom this notice has been given, or who uses the said Public Footpath and any other person who would be aggrieved by the making of the said Order, should provide any objections or representations must be made in writing and sent to Legal Services, FAO Alison Ennett, Atlas House, St Helens, Merseyside, (quoting HW/186/16858) not later than 16 December 2022. Part 1 - Description of Site of Existing Footpath

The section of existing public footpath concerned begins at the Southern end of Public Bridleway No. 214 at point A (Grid Ref: 349764, 393492) before continuing in a Northerly then North-westerly direction to point B (Grid Ref: 349779, 393713) and is shown as a magenta line and being particularly delineated on the deposited plan Drawing Number: CONS/HD/JE/PROW/214/DP/01. There is no width currently described in the Definitive Statement relating to the whole length of Public Footpath No. 214. The total distance between points A-B is 228 metres.

Part 2 - Description of Site of Alternative Footpath
The diversion begins on proposed footway at point C (Grid Ref: 349774, 393611) the proposed diversion will cross the new carriageway in a North-westerly direction to point D (Grid Ref: 349768, 393623) before travelling in a North Easterly direction along a new paved footway to point E (Grid Ref: 349808, 393678) and from point E the route will travel North westerly to point F (Grid Ref: 349793, 393698) and is shown as a dashed blue line and being particularly delineated on the deposited plan Drawing Number: CONS/HD/JE/PROW/214/DP/01. The proposed width for the section C-D-E-F is 2 metres. The total distance between points C-D-E-F is 151 metres. The section of Public Footpath 214 from point F to its North Western termination at Thatto Heath Park is to remain on its current alignment
