The Developments of National Significance (Procedure) (Wales) Order 2016 Publicity Consultation Before Applying For Planning Permission Notice Under Articles 8 And 9(2)Purpose of this notice: this notice provides the opportunity to comment directly to the developer on a proposed Development of National Significance (DNS) prior to the submission of a planning application to Welsh Ministers. Planning applications for DNS will be publicised by Welsh Ministers and the relevant local planning authority; any comments provided in response to this notice will not prejudice your ability to make representations to the Welsh Ministers on any related DNS planning application. You should note that any comments submitted may be placed on the public file.

Proposed development at Mynydd Llanhilleth, South Wales. The Site boundary is approximately 300m from the eastern edge of Llanhilleth. The village of Brynithel is located approximately 500m to the south west of the Site at its closest point. (Grid reference: Easting, 323634 - Northing, 201932)
I give notice that Pennant Walters Ltd is intending to apply to the Welsh Ministers for planning permission in respect of Development of National Significance which is for a "proposed wind farm consisting of up to eight wind turbines, each with a three-bladed rotor with a diameter of up to 150m, a hub height of up to 122m and maximum height to blade tip of 180m, together with associated infrastructure including access improvements, new and improved internal wind farm tracks, crane pads, temporary construction compound, laydown and storage areas and grid connection infrastructure, including an on-site substation".
And considers that the following secondary consents are connected to the proposed application and that a decision in respect of those consents is to be made or should be made by the Welsh Ministers, or a person appointed by the Welsh Ministers for that purpose:
- Under section 16(1) of the Commons Act 2006 (deregistration and exchange applications):

Application to construct and operate a wind farm within Mynydd Llanhilleth Common requiring the deregistration of 2.7ha of common land and exchange with 4ha of compensatory land to be registered as common land.
- Under section 38(1) of the Commons Act 2006 (prohibition on works without consent): Application to to allow works to take place on both the release land (works required to construct the proposed wind farm) and the replacement land (fencing to delineate the common from adjoining freehold land).

- Under section 247(1) of the 1990 Act (order authorising stopping up or diversion of highway): Consent to divert a public right of way away from the wind turbines.

Diben yr hysbysiad hwn: mae'r hysbysiad hwn yn rhoi cyfle i wneud sylwadau'n uniongyrchol i'r datblygwr ar Ddatblygiad o Arwyddocad Cenedlaethol (DNS) arfaethedig cyn cyflwyno cais cynllunio i Wcinidogion Cymru. Bydd ceisiadau cynllunio ar gyfer DNS yn cael eu cyhoeddi gan Weinidogion Cymru a'r awdurdod cynllunio lleol perthnasol; ni fydd unrhyw sylwadau a ddarperir mewn ymateb i'r hysbysiad hwn yn rhagfarnu eich gallu i gyflwyno sylwadau i Weinidogion Cymru ar unrhyw gais cynllunio DNS cysyMedig. - O dan adran 16(1) o Ddeddf Tiroedd Comin 2006 (ceisiadau dadgofrestru a chyfnewid): Cais i adeiladu a gweithredu fferm wynt o fewn Comin Mynydd Llanhiledd sy'n gofyn am ddadgofrestru 2.7ha o dir comin a chyfnewid a 4ha o dir cydadferol i'w gofrestru fel tir comin.

- O dan adran 38(1) o Ddeddf Tiroedd Comin 2006 (gwaharddiad ar waith neb ganiatad): Cais i ganiatau i waith gael ei wneud ar y tir rhyddhau (gwaifh sydd ei angen i adeiladu'r fferm wynt arfaethedig) a'r tir amnewid (ffensio i diffinio'r comin o dir rhydd-ddaliol cyfagos).
