HIGHWAYS ACT 1980 AND WILDLIFE AND COUNTRYSIDE ACT 1981
CUMBRIA COUNTY COUNCIL FOOTPATH NOS 136012 & 136015 PARISH OF WATERHEAD PUBLIC PATH DIVERSION AND DEFINITIVE MAP MODIFICATION ORDER 2012
On the 22 November 2022 Cumbria County Council confirmed the above order made under Section 119 of the Highways Act 1980 and Section 53 of the Wildlife and Countryside Act 1981.
The effect of the order as confirmed is to divert that section of public footpath no 136012 from grid reference 358385 564342 generally northwards for about 357 metres to grid reference 358474 564649: to run from public road No.1052 at grid reference 358393 564342 generally northwards for about 400 metres alongside the River Irthing to then run for about 173 metres generally westwards then eastwards to grid reference 358474 564649; and that section of public footpath no 136015 from grid reference 358103 564239 generally eastwards for about 306 metres to grid reference 358358 564342: to run from grid reference 358103 564239 generally eastwards for about 302 metres alongside the River Irthing to join public road No.U1052 at grid reference 358368 564345.
The width of the new sections of footpath will be 1.8 metres.
A copy of the Order as confirmed and map may be inspected free of charge at Brampton Library, 1 Market Place, Brampton and the offices of the Countryside Access Team, The Parkhouse Building, Kingmoor Business Park, Carlisle CA6 4SJ by appointment only (ref 5.1.322). Details of the Order are available to view on the County Council's website and copies of the Order may be purchased at a cost of £2 per A4 sheet and £3 per A3 sheet.

The order comes into force on 25 November 2022, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 25 November 2022 make an application to the High Court.
NOTICE is also given that an Agreement has been entered into under Section 25 of the Highways Act 1980 the effect of which will be to add a 1.8 metre wide section of public footpath from the junction with public footpath no 136012 northeastwards for about 641 metres alongside and above the River Irthing within wooded areas to meet public footpath no 136017. There is no right of objection and the Agreement has taken immediate effect.
