Notice of Application for the transfer of a Licence. Western Administrative Court Division

TAKE NOTICE
that I George Beatty of Fallow House, Saloon, Ballinamallard, County Fermanagh intend to apply at the Magistrates Court sitting at Enniskillen on the 14th day of December 2022 at 10am for the transfer to me of a Licence at present held by Alan Hurst and Helen Hurst of Tullyrain, Ballinamallard aforesaid for the premises situate at and known as "L'Horizon" (formerly known as "The Steakhouse"), 66 Main Street, Ballinamallard aforesaid being premises of the following kind according to the Licensing (Northern Ireland) Order 1996, namely premises specified in Article 5(1 )(e) a restaurant i.e. premises (other than those referred in Article 5(1 )(a) of the Order) structurally adapted and used, or intended to be used, for the purpose of providing persons frequenting the premises with a main table meal at midday or in the evening, or both

A Protection Order authorising the said George Beatty to carry on business under the Licence was granted on the 6th day of July 2022 by the Magistrates Court sitting at Enniskillen for the period of six months from the date of the Order.
I am the owner of the business carried on under the Licence.

The owner of the premises is Beatty Hardware and Farm Supplies Limited the registered office of which is situate at 68 Main Street, Ballinamallard aforesaid. The Directors of Beatty Hardware and Farm Supplies Limited are the said George Beatty and Hilary Beatty both of Fallow House, Saloon, Ballinamallard aforesaid.

The Licence will be deposited with the Clerk of Petty Sessions before or at the hearing of the Application.
FURTHER TAKE NOTICE that any person owning or residing or carrying on business in premises in the vicinity of the premises for which the transfer of the Licence is sought who intends to object must in accordance with paragraph 4 of Schedule 5 of the said Order serve Notice of Intention to Object upon the Applicant and the Clerk of Petty Sessions not less than one week before the hearing of the Court application.
AND FURTHER TAKE NOTICE
that the permissible grounds of objection are specified in Article 22(6) of the said Order namely unfitness of the applicant, failure to comply with the correct procedure or that the business carried on in the premises under the Licence has been discontinued.
