Notice Of Confirmation Of Public Path Order Highways Act 1980 Isle Of Wight Council Public Footpath CB4 (Part) Marks Corner Newport Isle Of Wight Diversion Order No. 1 2022

On 14 November 2022 the Isle of Wight Council confirmed the above order made under section 119 of the Highways Act 1980.

The effect of the order as confirmed is to stop up a section of Public Footpath CB4 starting at the junction of the entrance drive to the property known as Myrtle Cottage and Mark's Corner Road and heading north west for approximately 30m and continuing westerly along the entrance drive of Jubilee Dairy for approximately 18m and then heading over the grounds of Jubilee Dairy in a north north west direction for approximately 150m to the north east corner of the grounds; and create an alternative footpath instead starting at the junction of the northern side of the entrance driveway to Jubilee Dairy and Marks Corner Road heading west along the driveway for approximately 24m and continuing in the same direction on the northern side of a timber fence for approximately 15m and then continues in a general northerly direction between fencing and hedging for approximately 160m to the north east corner of the grounds of Jubilee Dairy; as shown on the order map.

A copy of the order as confirmed and the order map have been placed and may be seen free of charge at the Customer Service Centre, County Hall, High Street, Newport, Isle of Wight during normal office hours. Copies of the order and map may be obtained there free of charge.

The order comes into force on 28 November 2022, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 18 November 2022, make an application to the High Court.
