Notice Of Confirmation Of Public Path Order Highways Act 1980 Isle Of Wight Council Public Footpath CB15A (Part) Newtown Isle Of Wight Diversion Order No. 1 2022

On 14 November 2022 the Isle of Wight Council confirmed the above order made under section 119 of the Highways Act 1980.

The effect of the order as confirmed is to stop up a section of Public Footpath CB15A: starting at its junction with public footpath CB9 at grid reference 41990 90952 running in a general east north east direction on the northern side of a post and wire fence demarking the southern boundary of a salt marsh for approximately 128 metres and then turning south and continuing for approximately 22 metres to its junction with a National Trust path providing access to its observation post; and create an alternative footpath instead: starting at its junction with public footpath CB9 at Grid Ref. 41992 90932 heading north east north across a meadow for approximately 132 metres to its junction with both public footpath CB15A and the aforesaid National Trust path providing access to its observation post; as shown on the order map.
A copy of the order as confirmed and the order map have been placed and may be seen free of charge at the Customer Service Centre, County Hall, High Street, Newport, Isle of Wight during normal office hours. Copies of the order and map may be obtained there free of charge.

The order comes into force on 28 November 2022, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 18 November 2022, make an application to the High Court.
