Notice Of Application For Grant Of Licence Authorising The Sale Of Intoxicating Liquor By Retail In A Restaurant In The County Court For Northern Ireland Western Division

TAKE NOTICE that I, Nicholas Rooney, of Tulleevin Park, Ennlsklllen, In the County Fermanagh, Intend to apply to the County Court sitting at The Courthouse, High Street, Omagh, County Tyrone, BT78 1DG for the above Division commencing at 10.30am in the forenoon on the 6th day of December 2022 for the grant of a licence for the premises situated at Unit 4, 48 Cornagrade Road, Cornagrade, Enniskillen, in the County of Fermanagh, BT74 6DX being restaurant premises such as are specified in Article 2 of the Licensing (Northern Ireland) Order 1996, namely, premises not being premises of a kind mentioned in Article 5(1 )(a) in which there is carrying on the business of selling meals or refreshments, which are to be used for the purpose of providing persons frequenting the premises with a main table meal at midday or in the evening, or both.

AND TAKE NOTICE that this application will be dealt with by the Court on the 6th day of December 2022 commencing at 10.30am.
I am the owner of such business.
The owner of the premises is Crownhall Enterprises Limited having its registered office at Wellington House, 30
Darling Street, Enniskillen, County Fermanagh, BT74 7EW. A plan of the premises separately delineating each part or parts of the premises as specified in Rule 6 of Order 48 of the County Court Rules (Northern Ireland) Order 1981 is attached to this notice in accordance with Schedule 1 to the said Order.

There is in force Planning Permission to use the premises as premises of the kind specified in this notice for the period during which the Licence would be in force and a copy of the Planning Permission is attached.
FURTHER TAKE NOTICE that I intend to apply under Article 59 of the said Order for a children's certificate in respect of the part of the premises particularly delineated on the said plan and for a direction under Article 59(4) of the said Order that the said certificate shall operate between the hours of 11.30am and 9.00pm on Mondays to Saturdays and 12.30pm - 9.00pm on Sundays. Any person, owner who are residing and carrying on business in the vicinity of the premises for which the licence is sought who intends to object to the grant of the licence must in accordance with paragraph 6 of the Schedule 1 to the Licencing Order, serve notice of his or her intention to object upon the applicant on the Chief Clerk not less than one week before the time of the opening of the Court sittings specified in the notice so published.

The permissible grounds from objection are as such as specified in Articles 7(4) (a) 2 (c) (1) of the Licencing Order namely;
(i) Failure to comply with the correct procedure.

(ii) The unfitness of the applicant.

(iii) That the premises are not of the kind specified in the application.

(iv) The premises are unsuitable.

(v) The premises are unsuitable for children on the grounds specified in Article 59 (2) of the said Order.
