Notice of Making

NOTICE IS HEREBY GIVEN that Wigan Borough Council, in exercise of its powers under Sections 1, 2, 3, 4 and 5 of the Road Traffic Regulation Act 1984 and the Traffic Management Act 2004, has made the Wigan Borough (Decriminalisation of Parking) (Leigh Roads) (Traffic Regulation Consolidation) Order 2004 (Amendment No.138) Order 2022 which will come into operation on 17th November 2022. The effect of the Order will be to introduce no waiting at any time on:

* Pennington Flash Access Road (including two side spur locations for additional car parking which are now closed) on both sides from its junction with St Helens Road to Pennington Flash Car Park being a distance of 723 metres.

The effect of the Order will be to introduce Disabled Persons Parking Spaces on:

* Pennington Flash Access Road on its east side from a point 471m from its junction with St Helens Road to a point 481m from its junction with St Helens Road which will be in operation at any time.

A copy of the proposed Order, the Order to be amended, and of the relevant map and of a statement of the reasons for proposing to make the Order may be requested by post, or by emailing

. Any person who desires to question the validity of the Order or any provision contained therein on the ground -
(a) that it is not within the powers of Section 1 of the Road Traffic Regulation Act 1984; or the Traffic Management Act 2004 or

(b) that any requirement of the said Section 1, or of Part III of Schedule 9 to the Road Traffic Regulation Act 1984, or of any regulations made under the said Part III of Schedule 9 or of any requirement of the 2004 Act, has not been complied with, may within six weeks of 20th October 2022 make application for the purpose to the High Court.
