FORM 4 LICENSING (NORTHERN IRELAND) ORDER 1996 Article 23, Schedules 4 and 5 Notice of Application for the Transfer and Renewal of a Licence

IN THE WESTERN ADMINISTRATIVE COURT
DIVISION MAGISTRATES' COURT OF NORTHERN IRELAND AT DUNGANNON TAKE NOTICE that Beatty Retail Ltd having its registered office at 11 Trillick Road, Ballinamallard, Enniskillen, Co Fermanagh, BT94 2JJ intends to apply to the Magistrates' Court sitting at Dungannon Courthouse, Killyman Road, Dungannon BT71 6DE on the 16th day of November 2022 at 10.00am for the transfer of a licence at present held by Alexander Gerard Beatty of 11 Trillick Road, Drumrainey, Ballinamallard, Co Fermanagh, BT94 2JJ for the premises at 32-34 Main Street, Fivemiletown, Co Tyrone being premises of the following kind according to the Licensing (Northern Ireland) Order 1996, namely premises specified in Article:-5 (1) (b) premises in which the only business carried on under the licence is the business of selling intoxicating liquor by retail for consumption off the premises Beatty Retail Ltd aforesaid is the owner of the business to be carried on under the licence. The directors of Beatty Retail Ltd aforesaid are Alexander Gerard Beatty and Karen Anne Beatty both of 11 Trillick Road, Drumrainey, Ballinamallard, Enniskillen, Co Fermanagh, BT94 2JJ.

The owner of the premises is Matryan Properties Ltd the registered office of which is situate at 11 Trillick Road, Drumrainey, Ballinamallard, Co Fermanagh, BT94 2JJ. AND FURTHER TAKE NOTICE that any person owning or residing or carrying on business in premises in the vicinity of the premises for which the transfer of Licence is sought who intends to object to the grant of such Transfer of the Licence must, in accordance with paragraph 4 of Schedule 5 to the Licensing (Northern Ireland) Order 1996 serve notice of intention to object upon the Applicant and the Clerk of Petty Sessions, not less than one week before the time of the court sitting specified herein. AND the permissible grounds of objection are such as are specified in Article 22 (6) (a) to (c) of the Licensing (Northern Ireland) Order 1996, namely failure to comply with correct procedure, unfitness of the Applicant or discontinuance of the business.
No alteration such as is specified in Article 31 of the Licensing (Northern Ireland) Order 1996 has been made to the premises since the licence was last granted (or, in the case of a first renewal, since it was granted). As the existing licence expired on 30 September 2022. TAKE NOTICE that at the same time Alexander Gerard Beatty aforesaid intends to apply to the court to renew the licence until the expiration of the current licensing period, i.e. 30 September 2027 before transferring it to Beatty Retail Ltd. The licence will be deposited with the clerk of petty sessions before or at the hearing of the application
