Notice Of Confirmation Of An Order Highways Act 1980 Section 119 Wildlife And Countryside Act 1981 Section 53(A)2 Worcestershire County Council Diversion Of Footpath KT-637 (Part), Formerly Footpath 39, In The Parish Of Knighton On Teme Public Path Diversion And Definitive Map And Statement Modification Order 2020
On 28 July 2022 the County Council confirmed the above Order made under Section 119 of the Highways Act 1980 and section 53A (2) of the Wildlife and Countryside Act 1981. The effect of the Order as confirmed is to divert the Public Footpath by: Diverting the length and entire width of footpath KT-637, in the parish of Knighton on Teme commencing at its junction with Bridleway KT-627/KT-628 at Ordnance Survey (O.S.) grid ref SO 6442 6986. The path proceeds in a generally east south-easterly direction, for a distance of 109 metres, along a track to O. S. grid ref SO 6451 6980. The path then turns and continues in a generally south south-easterly direction, for a distance of 55 metres, along a track and across the farmyard of Oxnalls Farm to a gate at O. S. grid ref SO 6453 6975. The path then continues in a generally southerly direction, for a distance of 51 metres, to O.S. grid ref SO 6453 6970 and then turns to continue in a generally south westerly direction, for a distance of 84 metres, to a point at O.S. grid ref SO 6447 6964. The total distance of footpath to be diverted is 299 metres. To a point commencing at its junction with Bridleway KT-628 at O.S. grid reference SO 6436 6974 with a width of 2 metres. The path proceeds in a generally east south-easterly direction for a distance of 2 metres, through a gate in the hedge at O.S. grid reference SO 6436 6974. The path then turns in a generally south south-westerly direction to follow the field edge to the east of the hedgerow, for a distance of 17 metres, to O.S. grid reference SO 6436 6972. The path then turns in a generally south easterly direction and continues for a distance of 112 metres along the field edge on the north eastern side of the hedge. The path crosses the fence/hedge line through a gate at O.S. grid reference SO 6445 6965 and continues in a generally easterly direction for a distance of 25 metres to O.S. grid reference SO 6447 6965. The path then turns to follow the slope of the hill and continues in a generally southerly direction for 4 metres to Grid Reference SO 6447 6964. The total distance of the diverted footpath is 160 metres.

The Order came into force on 25 August 2022 but if a person aggrieved by the Order wants to question its validity, or that any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act within 6 weeks from 20 October 2022 make an application to the High Court.
