NOTICE OF SET DOWN OF APPLICATION FOR JUDGMENT BY DEFAULT IN OPEN COURT IN TERMS OF RULE 31(5)(B)(vi) READ TOGETHER WITH RULES 46 AND 46A
PLEASE TAKE NOTICE that the Applicant herein intends to make application to the above Honourable Court for Judgment by Default against the Respondents, jointly and severally, on the 20thday of OCTOBER 2022 at 09H00 or as soon thereafter as Counsel may be heard for Judgment in the following terms:
1. payment of the sum of R 1 355 414.01;
2. interest on the sum of R 1 355 414.01 at the variable rate, currently 5.150% per annum from 09 APRIL 2021 to date of payment, both dates inclusive, together with finance charges permitted in terms of section 101 and 102 of the National Credit Act, 34 of 2005;
3. an Order declaring the following property specially executable:
ERF 388 SUIDEROORD TOWNSHIP, REGISTRATION DIVISION I.R., THE PROVINCE OF GAUTENG, MEASURING 635 (SIX HUNDRED AND THIRTY-FIVE) SQUARE METRES, HELD BY DEED OF TRANSFER T047092/2007, SUBJECT TO ALL THE TERMS AND CONDITIONS CONTAINED THEREIN
4. an Order authorising the issue of a writ of a warrant of attachment in terms of Rule 46 as read with Rule 46A for the attachment of the Property;
5. that a reserve price be set for the sale of the Property, at a sale in execution, at a value to be determined by the Honourable Court;
6. costs of suit on the attorney client scale;
7. further and/or alternative relief.
