The York Parking. Stopping and Waiting (amendment) (no 14/50) Traffic Order 2022

NOTICE OF MAKING Notice is hereby given that on the 22nd day of September 2022 City of York Council, in exercise of powers under Sections 1,2,4, 32,35,45,46,53 and Schedule 9 of the Road Traffic Regulation Act, 1984 ("the Act") and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Schedule 9 of the Act, made an Order which has the effect of:

1. Introducing 'No Waiting at any time' restrictions in York as follows:

(a) Albany Street, on both sides:

(i) between the projected northern kerbline of Hanover Street East and a point 6 metres north of the said line,

(ii) between the projected southern kerbline of Bromley Street and a point 6 metres south of the said line

(b) Almsford Road, on both sides, between the projected eastern kerbline of Beckfield Lane and a point 15 metres east of the said line;

(c) Askham Croft on its;

(i) west side, between its southern kerbline of Tedder Road and the northern kerbline of Askham Croft,

(ii) east side, between the southern kerbline of Tedder Road and a point 10 metres south of the said line,

(iii) east side, between the northern kerbline of Askham Croft and a point 10 metres north of the said line,

(d) Askham Lane, on it north west side, between the projected western kerbline of Ridgeway and the eastern kerbline of Grange Lane (terminal point of existing 'No Waiting at any time restrictions'),

(e) Balfour Street, on its:

(i) north west side, between points 8 metres north from the projected northern kerbline of Carnot Street and a point 8 metres south from the projected southern kerbline of Carnot Street,

(ii) north west side, between points 8 metres north from the projected northern kerbline of Roseberry Street and a point 8 metres south from the projected southern kerbline of Roseberry Street,

(iii) south east side, between points 10 metres north from the projected northern kerbline of Stephenson Way and a point 10 metres south from the projected southern kerbline of Stephenson Way,

(f) Beckfield Lane, on its:

(i) east side, between the projected southern property boundary line of No. 27 Lidgett Grove and the projected northern property boundary line of No. 30 Lidgett Grove,

(ii) east side, from the projected centreline of Ouseburn Avenue north for 20 metres and south for 20 metres,

(iii) east side, from the projected centreline of Almsford Road to a point 17 metres south of the said point

(g) Bright Street on its north west side:

(i) between points 8 metres north from the projected northern kerbline of Bromley Street and a point 8 metres south from the projected southern kerbline of Bromley Street,

(ii) between points 8 metres north from the projected northern kerbline of Hanover Street East and a point 8 metres south from the projected southern kerbline of Hanover Street East,

(h) Broadway, on its north side, between a point 4 metre west of the projected eastern property boundary line of No. 28 Broadway and a point 53 metres east of the said line,

(i) Bromley Street, on its:

(i) south side, between points 6 metres east from the projected eastern kerbline of Albany Street and a point 6 metres west from the projected western kerbline of Albany Street,

(ii) both sides, between the projected western kerbline of Bright Street and a point 8 metres south of the said line Q) Burns Court, on its:

(i) north side, between the projected eastern and western kerbline of Bums Court,

(ii) east side, between the projected northern kerbline of Burns Court and a point 5.5 metres south of the said line,

(k) Burton Stone Lane, on its north west side, between points 118 metres (terminal point of existing 'No Waiting at any time'
restrictions) and 146 metres north east from the projected centreline of Surtees Street, (I) Carmelite Street, south east side, between points 3 metres (terminal point of existing 'No Waiting at any time' restrictions) and 13
metres from the highway boundary line on the north east side of Garden Place, thereby revoking the existing 'Pay and Display' bay
from within that length,
(m) Carnot Street, on both sides, between the projected north western kerbline of Balfour Street and a point 8 metres north west from the said line,
(n) Chalfonts, on its north side, between the projected western kerbline of Tadcaster Road and a point 100 metres west of the said line,
(o) Danebury Drive, on its:

(i) north west side, between the projected north eastern kerbline of Wetherby Road and a point 20 metres north from the said line,

(iii) south east side, between the projected north eastern kerbline of Wetherby Road and a point 36 metres north from the said line,

(p) East Parade, on its north side, between points 8 metres east and 8 metres west from the projected centreline of Parade Court,

(q) Elmfield Avenue, on both sides, from the projected south eastern kerbline of Monkton Road south east for 20 metres,

(r) Elmfield Terrace, on both sides, between its kerbline junction with Stray Garth and a point 10 metres north of said line,

(s) Fenwick Street, on its south side, between points 122 metres (terminal point of existing 'No Waiting at any time' restrictions) and 144 metres south from the projected highway boundary line on the south side of Charlton Street (t) Grange Garth, on its south east side, between points 74.5 metres and 79.5 metres south from the projected south western kerbline of New Walk Terrace (terminal point of existing 'No Waiting at any time' restrictions), thereby revoking existing residents parking bay from within that length,

(u) Grange Lane, between the projected north western kerbline and the south eastern kerbline of Grange Lane (terminal point of existing 'No Waiting at any time restrictions'), (v) Hanover Street East, on its:

(i) north side, between points 6 metres east from the projected eastern kerbline of Albany Street and a point 6 metres west from the projected western kerbline of Albany Street,

(ii) both sides, between the projected western kerbline of Bright Street and a point 8 metres south of the said line (w) Haxby Road, on its:

(i) east side, between points 21 metres (terminal point of existing 'No Waiting at any time' restrictions) and 121 metres south from the projected northern kerbline of the historic Nestle Rowntree Car Park,

(ii) west side, between points 50 metres (terminal point of existing 'No Waiting at any time' restrictions) and 130 metres (terminal point of existing 'No Waiting at any time' restrictions) north from the projected northern property boundary line of 155 Haxby Road,

(x) Jervis Road, on:
(i) both sides, from the projected south eastern kerbline of North Lane south west for 10 metres,

(ii) both sides, from the projected north eastern kerbline of Thanet Road north east for 13 metres,

(y) Lidgett Grove, on both sides, between the projected eastern kerbline of Beckfield Lane and a point 10 metres east of the said line, (z) Lovel House Access road, on both sides, from the projected north western kerbline of Wains Road north west for 8 metres (aa) Monkton Road, on its:

(i) north side, from the projected south western kerbline of Elmfield Avenue south west for 20 metres,

(ii) south side, between a point 20 metres south west from the projected south western kerbline of Elmfield Avenue and a point 20 metres north east from the projected north eastern kerbline of Elmfield Avenue,

(ab) North Lane, on its:
(i) north side, between points 15 metres west and 20 metres east from the projected centreline of Orchard Way,

(ii) south side, between points 10 metres north west and 10 metres south east from the projected centreline of Jervis Road

(ac) Orchard Way, on both sides, between the projected northern kerbline of North Lane and a point 12 metres north of the said line,

(ad) Ouse Acres, on its west side, between a point 20 metres north east from the north eastern kerbline of Boroughbridge Road (terminal point of existing 'No Waiting at any time' restrictions) to a point 13 metres south west from the projected centreline of Prior's Walk (terminal point of existing 'No Waiting at any time' restrictions),

(ae) Ouseburn Avenue, on both sides, between the projected eastern kerbline of Beckfield Lane and a point 15 metres east of the said line

(af) Paddock Way, on both sides, between the projected western kerbline of Paddock Way and a point 10 metres west from the said line,

(ag) Plantation Drive, on its;

(i) west side, between points 18 metres (terminal point of existing 'No Waiting at any time') and 58 metres north east of the north eastern kerbline of Boroughbridge Road,

(al) Seventh Avenue, on both sides, between its roundabout controlled junction with Fourth Avenue and a point 24 metres south, (am)Shipton Road, on its south west side, between points 10 metres and 65 metres north west from the projected centreline of Homestead Park access road,

(an) Stephenson Way, on both sides, between the projected south eastern kerbline of Balfour Street and a point 10 metres south east from the said line,

(ao) Stray Garth, on both sides, between its kerbline junction with Elmfield Terrace and a point 10 metres east of said line,

(ap) Swinerton Avenue, on it north side, between the projected eastern property boundary line of No. 18 Swinerton Avenue and a point 10 metres east (including the turning area), (aq) Thanet Road, on its north side, between the projected eastern property boundary line of No. 12 Ebor Court and a point 30 metres
north west of the said line, (ar) The Square, on its:

(i) north side and west side, between the projected eastern kerbline of Tadcaster Road and a point 42 metres north east of the said line

(ii) south side, between the projected eastern kerbline of Tadcaster Road (terminal point of existing 'No Waiting at any time' restrictions) and a point 69 metres west of the said line

(as) Yearsley Crescent on its:

(i) north side, between the projected western kerbline of Yearsley Crescent and a point 10 metres west of the said line,

(ii) west side, between the projected northern kerbline of Yearsley Crescent and a point 10 metres north of the said line,

2. Introducing 'No Waiting at any time' restrictions in Bishopthorpe, as follows: (a) Acaster Lane, on its:

(i) both sides, between the projected southern kerbline of Main Street and a point 15 metres south of the said line,

(ii) west side, between points 10 metres north from the projected northern kerbline of Canon's Court and 10 metres south from the projected southern kerbline of Canon's Court,

(b) Canons Court, on both sides, between the projected western kerbline of Acaster Lane and a point 45 metres west of the said line,

(c) Copmanthorpe Lane, on its:

(i) north side, between points 17 metres (terminal point of existing 'No Waiting at any time restrictions') and 28 metres north west from the projected northern kerbline of Main Street,

(ii) south side, between points 14 metres (terminal point of existing 'No Waiting at any time restrictions') and 22 metres north west from the projected northern kerbline of Main Street,

3. Introducing 'No Waiting at any time' restrictions in Fulford as follows:

(a) Connaught Court, on both sides, between the projected southern kerbline St Oswald's Road and a point 10 metres south,

(b) Heslington Lane, on its south side, between the projected eastern property boundary lines of No.'s 64 and 70 Heslington Lane,

(c) Love Lane, on both sides, between the projected northern kerbline St Oswald's Road and a point 10 metres north,

(d) St Oswald's Road, on its:

(i) north side, between the projected eastern kerbline Love Lane and a point 10 metres east from the said line,

(ii) south side, between points 15 metres east and 15 metres west from the projected centreline of Connaught Court

4. Introducing 'No Waiting at any time' restrictions in Alwyne Drive, Rawcliffe, on both sides, between the northern kerbline of Shipton Road (A19) and a point 25 metre north east from the said line,

5. Introducing 'No Waiting at any time' restrictions in Murton, as follows:

(a) Cavendish Grove, on both sides, between the projected western kerbline of Tranby Avenue and a point 10 metres west from the said line,

(b) Tranby Avenue, on its:

(i) both sides, from the projected northern kerbline of Hull Road to a point 20 metres north from the said line,

(ii) west side, between a point 10 metres south of the southern kerbline of Cavendish Grove and a point 10 metres north of the northern kerbline of Cavendish Grove,

6. Introducing 'No Waiting at any time' restrictions in Wigginton, as follows:

(a) Broad Oak Lane, on both sides, form the projected southern kerbline of Greenshaw Drive south for 10 metres,

(b) Greenshaw Drive, on its:

(i) south side, between points 10 metres west from the projected western kerbline of Broad Oak Lane and 10 metres east from the projected eastern kerbline of Broad Oak Lane,

(ii) both sides, between points 10 metres and 35 metres west from the projected property boundary line of No. 175 Greenshaw Drive,

(c) Plantation Way, on both sides, between the projected eastern kerbline Green Dike and a point 8 metres east from the said line,

(d) The Village, on its north side, between points 10 metres north east and 13 metres south west from the projected centreline of Village Garth,

(e) Village Garth, on both sides, from the projected northern kerbline of The Village north for 10 metres.

7. Introducing 'No Waiting at any time' restrictions in Huntington as follows:

(a) Anthea Drive, on its north side, between points 10 metres west from the projected western kerbline of Maythorn Road and 10 metres east from the projected eastern kerbline of Maythorn Road,
(b) Avon Drive, on both sides, from the projected eastern kerbline of Strensall Road and a point 15 metres east from the said line,

(c) Burn Estate, on its:

(i) north side, between points 16 metres (terminal point of existing 'No Waiting at any time' restrictions) and 21 metres north west from the projected north western kerbline of Huntington Road,

(ii) north side, between points 35 metres and 50 metres north west from the projected north western kerbline of Huntington Road

(iii) north side, from the projected eastern kerbline of Burn Estate and a point 8 metres east from the said line,

(iv) east side, from the projected northern kerbline of Burn Estate and a point 8 metres north from the said line

(v) south and east side, between points 13 metres (terminal point of existing 'No Waiting at any time' restrictions) and 81 metres north west from the projected north western kerbline of Huntington Road,

(d) Maythorn Road, on both sides, from the projected northern kerbline of Anthea Drive and a point 10 metres north from the said line,

(e) Strensall Road, on its east side, between a point 15 metres north from the projected northern kerbline of Avon Drive and a point 15 metres south from the projected southern kerbline of Avon Drive,

8. Introducing 'No Waiting at any time' restrictions in Millfield Lane, Nether Poppleton, on its south west side, between points 28 metres (terminal point of existing 'No Waiting at any time' restrictions) and 183 metres (terminal point of existing 'No Waiting at any time' restrictions) north west from the projected north western property boundary line of Park Side Cottage;

9. Introducing 'No Waiting at any time' restrictions in Station Road, Upper Poppleton, as follows:

(i) on its north east side, between points 25 metres (terminal point of existing 'No Waiting at any time' restrictions) and 40 metres north west from the level crossing,

(ii) on its south west side, between points 23 metres (terminal point of existing 'No Waiting at any time' restrictions) and 37 metres north west from the level crossing,

(iii) on its north east side, between points 25 metres (terminal point of existing 'No Waiting at any time' restrictions) and 40 metres south east from the level crossing,

(iii) on its south west side, between points 25 metres (terminal point of existing 'No Waiting at any time' restrictions) and 40 metres south east from the level crossing,
10. Introducing 'No Waiting at any time' restrictions in Front Street, Naburn, on its west side from the projected northern property boundary line of Shelloch House and a point 40 metres south west of the said line.

11. Introducing 'No Waiting at any time' restrictions in Landalewood Road, Rawcliffe, on its:

(i) south east, west side including the turning area, between a point 45 metres north east from the projected south western property boundary line of No. 1 Gillingwood Road and the projected western property building line of No. 10 Landalewood Road,

(ii) north eastern side, between the projected northern and southern property boundary line of No. 32 Landalewood Road,

12. Introducing 'No Waiting at any time' restrictions in Wheldrake as follows:

(a) Dalton Hill, on both sides, between the projected northern kerbline of Main Street and the projected northern property building line of Wenlock Arms,

(b) Main Street, on its:

(i) north side, between the projected eastern property boundary line of No. 62 Main Street and the eastern property boundary line of Wenlock Arms,

(ii) south side, between the projected eastern property boundary line of No. 62 Main Street and the projected western kerbline of Church Close,

13. Introducing 'No Waiting from 8am-6pm Monday to Friday' restrictions in George Cayley Drive, Rawcliffe, on its west side, between points 18 metres (terminal point of existing 'No Waiting 8am-6pm Monday to Friday' restrictions) and 128 metres north from the projected centreline of James Nicholson Link.

14. Introducing a Monday-Sunday Parking Places, providing a limited parking period of 60 minutes with a 60 minutes 'No Return' period, in Huntington, as follows:

(i) North Moor Road, on its east side, between points 4.5 metres and 20 metres south from the projected northern property boundary line of No. 43a North Moor Road,

(ii) North Moor Road, on its west side, between points 3.5 metres and 50.5 metres south from the projected northern property boundary line of No. 47 North Moor Road,

(iii) White Horse Close, on its south side, between point 12.5 metres and 25 metres east from the projected eastern kerbline of North Moor Road.

15. Introducing 'Residents' Priority parking bay providing unlimited parking for R6 Permit Holders and 10 minutes for Non Permit Holders on the north side of Fenwick Street, between points 117 metres (terminal point of existing 'No Waiting at any time' restrictions) and 139 metres south from the projected highway boundary line on the south side of Anne Street,

16. Introducing 'Residents' Priority' parking bay providing Monday to Sunday 6pm to 8am parking provision for R11 Permit Holders and 10 minutes for Non Permit Holders on the south west side of King's Staith Upper between the south eastern kerbline of Lower Friargate and a point 24 metres north west from the said line,

17. Introducing 'Residents' Priority' parking bay providing unlimited parking for R30 Permit Holders and 10 minutes for Non Permit Holders on Harcourt Street, on its east side, as follows:

(i) between the projected northern property boundary line of No. 7 Harcourt Street and a point 15 metres north of the said line,

(ii) between points 26 metres and 36 metres north from the northern property boundary line of No. 7 Harcourt Street, thereby revoking the existing 'No Waiting at any time' restrictions from within that length;

18. Revoking the 'Residents' Priority' parking place providing resident parking provision for R5 permit holders on Springfield Avenue, York, on its south side, as follows:

(i) from the projected eastern highway boundary line of Beech Avenue east for 23 metres,

(ii) between points 7.5 metres and 27 metres west from the centreline of Beech Avenue, thereby providing unrestricted parking within those lengths;

19. Re-defining 'Residents' Priority' parking area thereby bringing within the R65 (CLIFTON DALE) zone the residential property No. 1 Clifton Dale;

20. Re-defining 'Residents' Priority' parking area thereby bringing within the R6 (Bewley Street) zone the residential properties numbered 43-49 Fenwick Street;

21. Amending 'Operative Hours' of the parking provision in Garfield Terrace, York, on its north side, from the projected eastern property boundary line of No. 10 Garfield Terrace, so that the parking is amended from Monday to Saturday 7am to 5pm with a 30 minutes maximum period of stay so that it applies from Monday to Saturday 7am to 7pm with a 10 minutes maximum period of stay;

22. Amending 'Operative Hours' 'Residents Priority' parking provision in Glen Road, York, on its south side, between points 11 metres and 22.5 metres west from the projected centreline of Harcourt Street, so that the 'Residents Priority' parking is amended from Monday to Sunday at all times with a 60 minutes maximum period of stay for Non Permit Holders so that it applies Monday to Sunday at all times thereby providing unrestricted parking for Zone R30 Permit Holders with a 10 minutes maximum period of stay for Non Permit Holders;

Amending the eligibility of 'Residents Priority' parking provision in Fulford Road, York, on its:
(i) east side, between points 22 metres and 59 metres north from the projected centreline of Grange Street,

(ii) east side, between points 91 metres and 106 metres north from the projected centreline of Grange Street,

(iii) east side, between points 106 metres and 123 metre north from the projected centreline of Grange Street,

so that the 'Residents Priority' parking bays are amended to provide Community bays available for all R20 permit holders, thereby revoking the existing eligibility for household and business permits only, The Order comes into effect on 24th day of September 2022.

A copy of the Order incorporating relevant maps can be inspected at the Reception, West Offices, Station Rise, York, during normal business hours. Any person who wishes to question the validity of the Order or any of its provisions on the grounds that it is not within the powers of the Road Traffic Regulations Act 1984 as amended or that a requirement of any regulation thereunder has not been complied with may, within 6 weeks from the date of making of the Order, make application for that purpose to the High Court.
