NOTICE OF CONFIRMATION OF PUBLIC PATH DIVERSION, EXTINGUISHMENT AND CREATION ORDERS AND DEFINITIVE MAP
AND STATEMENT MODIFICATION ORDERS HIGHWAYS ACT 1980, WILDLIFE AND COUNTRYSIDE ACT 1981

1. The Oxfordshire County Council, Epwell Footpath No 8 (part), Epwell Bridleway No 10 (part) and Shutford Footpath No 14 (part), Public Path Diversion and Definitive Map and Statement Modification Order 2022.
2. The Oxfordshire County Council, Epwell Footpath No. 8 (part), Public Path Extinguishment and Definitive Map and Statement Modification Order 2022.
3. The Oxfordshire County Council, Epwell Footpath No. 8 (part), Public Path Creation and Definitive Map and Statement Modification Order 2022.

On 5th September 2022, the Oxfordshire County Council confirmed the above Orders under sections 119, 118 and 26 of the Highways Act 1980 respectively and section 53A(2) of the Wildlife and Countryside Act 1981. The effect of the Diversion Order as confirmed is to modify the Definitive Map and Statement for the area by diverting, as shown on the Order map:
Epwell FP8 running from SP 3792 4152 generally south-westwards for 123m to SP 3787 4141 to a new line running from OS Grid Ref SP 3792 4152 southwards for 74m to SP 3792 4146, south-westwards for 45m to SP 3788 4143 and southwards for 7m to SP 3788 4142 at
the Shutford Parish boundary;
Epwell BR10 running from OS Grid Ref SP 3753 4159 east-north-eastwards for 240m to SP 3777 4166 and north-eastwards for 122m to SP 3779 4179 to a new line running from OS Grid Ref SP 3753 4159 north-eastwards for 311m to SP 3779 4179;
Shutford FP14 running from SP 3787 4141 south-south-eastwards for 108m to SP 3793 4132 to a new line running from SP 3788 4142 at the Epwell Parish boundary south-south-eastwards for 112m to SP 3793 4132.

The effect of the Extinguishment Order as confirmed is to modify the Definitive Map and Statement for the area by extinguishing the cul-de-sac 146m length of Epwell FP8 running from SP 3782 4178 south-westwards for 126m to SP 3790 4169 and south-south-westwards for 20m to SP 3789 4166, as shown on the Order map.
The effect of the Creation Order as confirmed is to modify the Definitive Map and Statement for the area by adding a 2m wide route running from Shenington-with-Alkerton BR 2 at the Shenington-with-Alkerton Parish boundary at SP 3779 4179 southwards for 23m to SP 3780 4177, east-south-eastwards for 129m to SP 3791 4175, and southwards for 71m to SP 3789 4166, as shown on the Order map.

The Orders came into force on the date of confirmation but if any person aggrieved by any of the Orders wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 (the Act), as amended, and/or the powers of section 53A of the Wildlife and Countryside Act 1981 (WCA) or on the ground that any requirement of either Act or of any regulation made under them has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act and as applied by s53A(7) WCA, within six weeks from 8th September 2022 make an application to the High Court.
