NOTICE OF CONFIRMATION OF A PUBLIC PATH ORDER
HIGHWAYS ACT 1980
YORKSHIRE DALES NATIONAL PARK AUTHORITY
FOOTPATH NO. 79, MELBECKS DIVERSION ORDER 2022


On 2 August, 2022, the Yorkshire Dales National Park Authority confirmed the above Order made under Section 119 of the Highways Act 1980.

The effect of the Order as confirmed is to divert the public footpath running from a point on the southern side of Barney Beck at GR SE 0047 9950 in a west, north westerly direction for approx. 215 metres before bearing south, south west to a stile and continuing west for approx. 385 metres to GR SD 9990 9963 onto a line from GR SD 9990 9963 bearing north west and parallel with Barney Beck for approx. 375 metres to a pedestrian gate before descending the slope generally north easterly to a foot bridge and continuing north to join the footpath at GR SD 9961 9988, as shown on the Order map.

It will divert the public footpath starting from a point to the east of Birk Park at GR SE 0044 9928 westerly for approx. 70 metres within the curtilage of Birk Park before bearing west, south west to join the footpath at GR SE 0017 9918 onto a line from the same point east of Birk Park turning south east to a field gate and following the wall boundary in a south west direction and then south to a pedestrian gate before bearing west to join the track and footpath at GR SE 0036 9918, as shown on the Order map.

The Order comes into force from the date of confirmation of this Order, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 19 August, 2022, make an application to the High Court.
