Notice Of Application For The Transfer & Renewal Of A Licence

TAKE NOTICE that I, James Foy of 54 Creagh Road, Tempo, Co Fermanagh intend to apply at the Magistrates' Court sitting at Enniskillen on the 14th day of September 2022 to apply for the transfer to me of the Licence presently held by Rory Foy of 50 Clarnagh Road, Tempo, Co Fermanagh for the premises situate at and known as "The Milltown Manor", 61 Main Street, Tempo, Co Fermanagh being the premises of the following kind according to the Licensing (Nl) Order 1996, namely premises specified in Article 5(1 )(a) premises in which the business carried on under the licence is the business of selling intoxicating liquor by retail for the consumption either in or off the premises.
A Protection Order authorising James Foy of 54 Creagh Road, Tempo Co Fermanagh to carry on the business under the licence was granted on the 18th day of July 2022 by the Magistrates' Court sitting at Enniskillen Courthouse for the period of six months from the date of the order.
James Foy is the owner of the business carried on under the Licence.
The owner of the premises is the said James Foy. No alteration such as specified in Article 31 of the Licensing (Northern Ireland) Order 1996 has been made to the premises since the licence was last renewed.
The existing licence is due to expire on 30th September 2022.
TAKE NOTICE that at the same time it is intended to apply to the Court to renew the licence until the expiration of the next licensing period i.e. 30" September 2027 before transferring the licence.
The licence will be deposited with the clerk of petty sessions before or at the hearing of the application.
FURTHER TAKE NOTICE that any person owning or residing or carrying on business in the vicinity of the premises for which this licence is sought who intends to object to the grant of such Licence must, in accordance with Schedule 5 of the Licensing Order, serve notice of the intention to object upon the applicant and the Clerk of Petty Sessions, Courthouse, Enniskillen not less than one week before the 14th day of September 2022.
The permissible grounds of objections are as specified in Article 22(6) of the Order namely:
(a) That the procedure relating to the application, set out
in schedule 5 has not been complied with; or
(b) That the Applicant is not a fit person to hold a licence; or
(c) That the business carried on under the licence has been discontinued
