South Lakeland District Council (Footpath Nos 536209 And 536210
Parish Of Kendal) Public Path Diversion Order 2022
On 13 July 2022 South Lakeland District Council confirmed the above named Order made under Section 257 of the Town & Country Planning Act 1990.
The Order, as confirmed, will divert the entire width of that section of public footpath no 536209 situate at Glebe Walk in the parish of Kendal from GR 351648 491991 eastwards for about 18 metres to GR 351666 491994; to run from GR 351648 491991 northeastwards for about 24 metres to GR 351667 492005. The width of the new section of path will be 2.5 metres; and the entire width of that section of public footpath no 536210 situate at Glebe Walk in the parish of Kendal from GR 351659 491978 northeastwards for about 55 metres to GR 351682 492028; to run from GR 351659 491978 north-northeastwards for about 28 metres to GR 351667 492005 then northeastwards for about 28 metres to GR 351682 492028. The width of the new section of path will vary between 1.8 metres and 2.5 metres.
A copy of the Order and map may be inspected free of charge at Kendal Library, Stramongate, Kendal and the offices of the Countryside Access Team, The Parkhouse Building, Kingmoor Business Park, Carlisle CA6 4SJ by appointment only (ref 5.1.484). Details of the Order can be viewed on the County Council's website and copies of the Order may be purchased at a cost of £2 per A4 sheet and £3 per A3 sheet from the Countryside Access Team.
The order comes into force immediately, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Town & Country Planning Act, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, apply to the High Court for any of these purposes under Section 287 of the Town & Country Planning Act 1990, within 6 weeks from 28 July 2022 as required by paragraph 7 of the Schedule 14 to that Act
