Ar y 7fed Gorffennaf 2022, cadarnhaodd Cyngor Sir Penfro'r gorchymyn uchod. Effaith y gorchymyn fel y'i cadarnhawyd yw gwyro'r rhan honno o Iwybr cyhoeddus Rhif 87/24C, yn cychwyn o bwynt A (cyfeirnod grid OS SN1678245848) i bwynt B (cyfeirnod grid OS SN1678645864), fel y dangosir ar fap y Gorchymyn gan linell fras du i linell sy'n cychwyn o Bwynt A (Cyfeirnod grid OS SN1678245848), ac yn esgyn i gyfeiriad y gorllewin ar hyd set o risiau am tua 6.8 metr i Bwynt C (Cyfeirnod grid OS SN1677645851), gan droi i'r gogledd-ddwyrain am tua 2.3 metr i bwynt D (Cyfeirnod grid OS SN1677645852). O Bwynt D mae'r llwybr yn ymrannu, gan fynd ymlaen i gyfeiriad y gogledd-orllewin ar draws trac am tua 9.9 metr i Bwynt E (cyfeirnod grid OS SN1676945856), yna i gyfeiriad y gogledd yn gyffredinol am tua 11.4 metr i gysylltu a'r B4546 Heol Llandudoch ym Mhwynt F (cyfeirnod grid OS SN1676945867), ac o Bwynt D (cyfeirnod grid OS SN1677645852), gan fynd ymlaen i gyfeiriad y gogledd-ddwyrain yn gyffredinol am tua 16.5 metr i gysylltu a'r B4546 Heol Llandudoch ym Mhwynt B (cyfeirnod grid OS SN1678645864), fel y dangosir ar fap y Gorchymyn gan linell fras du doredig.
Gosodwyd copi o'r gorchymyn, fel y'i cadarnhawyd, a map y gorchymyn yn Is-adran Cynlluniau Datblygu, Cyfarwyddiaeth Datblygu, Cyngor Sir Penfro, Neuadd y Sir, Hwlffordd, a gellir eu gweld am ddim rhwng 9am a 5pm ar ddyddiau gwaith. Gellir prynu copi'au o'r gorchymyn a'r map yno am £2.68.
Bydd y gorchymyn yn dod i rym ar y dyddiad y bydd Cyngor Sir Penfro yn ardystio y cydymffurfiwyd a thelerau Erthygl 2 o'r gorchymyn, ond os bydd rhywun a dramgwyddir gan y gorchymyn eisiau cwestiynu ei ddilysrwydd, neu ddilysrwydd unrhyw ddarpariaeth sydd ynddo, ar y sail nad yw o fewn y pwerau a roddir gan y Ddeddf uchod, neu ar y sail na chydymffurfiwyd ag unrhyw ofyniad yn y Ddeddf neu unrhyw reoliad a wnaed o dan y Ddeddf mewn perthynas a'r gorchymyn, gall wneud cais i'r Uchel Lys am unrhyw un o'r dibenion hyn o dan adran 287 o Ddeddf Cynllunio Gwlad a Thref 1990 o fewn chwe wythnos i'r dyddiad pan gafodd yr hysbysiad ei gyhoeddi, fel sy'n ofynnol gan baragraff 7 o Ran 14 o'r Ddeddf. Notice Of Confirmation Of An Order Town And Country Planning Act 1990 - Section 257 The Pembrokeshire County Council Public Footpath No.87/24c (Part) In The Community Of St Dogmaels
Public Path Diversion Order 2022
On the 7th July 2022, Pembrokeshire County Council confirmed the above order. The effect of the order as confirmed is to divert that part of public footpath No.87/24C, commencing from point A (OS grid reference SN1678245848) to point B (OS grid reference SN1678645864), as shown on the Order map by a bold black line to a line commencing from Point A (OS grid reference SN1678245848) and ascending in a westerly direction along a set of steps for approximately 6.8 metres to Point C (OS grid reference SN1677645851), turning north easterly for approximately 2.3 metres to point D (OS grid reference SN1677645852). From Point D the path divides, proceeding in a north westerly direction across a track for approximately 9.9 metres to Point E (OS grid reference SN1676945856), then in a general northerly direction for approximately 11.4 metres to connect with the B4546 St Dogmaels Road at Point F (OS grid reference SN1676945867), and from Point D (OS grid reference SN1677645852), proceeding in a general north easterly direction for approximately 16.5 metres to connect with the B4546 St Dogmaels Road at Point B (OS grid reference SN1678645864), as shown on the Order map by a broken bold black line.
A copy of the order as confirmed and the order map have been placed and may be seen free of charge at the Development Planning Division, Development Directorate, Pembrokeshire County Council, County Hall, Haverfordwest, from 9.00 a.m. to 5.00 p.m. on working weekdays. Copies of the order and map may be bought there at the price of £2.68.
The order comes into force on the date on which Pembrokeshire County Council certify that the terms of Article 2 of the order have been complied with, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the above Act, or on the ground that any requirement of the Act, or of any regulation made under the Act has not been complied with in relation to the order, he or she may apply to the High Court for any of these purposes under section 287 of the Town and Country Planning Act 1990 within 6 weeks on which the notice is first published as required by paragraph 7 of Schedule 14 to the Act.
