(Colchester Borough) (Prohibition of Waiting, Loading and Stopping) and (On-Street Parking Places) (Civil Enforcement Area) (Amendment No.35) Order 2022
Notice is hereby given Colchester Borough Council acting on behalf of the North Essex Parking Partnership in exercise of the delegated powers of the traffic authority Essex County Council granted under an Agreement dated 31 March 2011 Has Made the above Order under Sections 1(1), 2(1) to (3), 4(1), 4(2), 32, 35, 45, 46, 49 and 53 and Parts III and IV of schedule 9 of the Road Traffic Regulation Act 1984.
The effect of the Order: This Order will be incorporated into The Essex County Council (Colchester Borough) (Prohibition of Waiting, Loading and Stopping) and (On-Street Parking Places) (Civil Enforcement Area) Consolidation Order 2019 'the 2019 Order' by:
1. The following definition in Article 3 of the 2019 Order listed in this Notice as Article 1(a), shall be replaced by the following definition in Article 1(b) of this Notice:
(a) "The 2007 Regulations" means the Civil Enforcement of Parking Contraventions (England) General Regulations 2007;
(b) "The 2022 Regulations" means the Civil Enforcement of Road Traffic Contraventions (Approved Devices, Charging Guidelines and General Provisions) (England) Regulations 2022.
2. The following definition in Article 3 of the 2019 Order listed
in this Notice as Article 2(a), shall be replaced by the following definition in Article 2(b) of this Notice:
(a) "Penalty Charge Notice" has the same meaning given by Regulation 8(1) of the 2007 Regulations;
(b) "Penalty Charge Notice" means a notice described in Section 78 of the 2004 Act having effect as if issued or served by a Civil Enforcement Officer or posted by the enforcement authority under any regulations for the time being in force under Section 78 of the 2004 Act.
3. The following provisions in Article 109 of the 2019 Order listed in this Notice as Article 3(a), shall be replaced by the following provisions in Article 3(b) of this Notice:
(a) The Penalty Charge shall be payable not later than 16.00 hours on the Applicable Date subject to the provisions of the Penalty Charge and the 2007 Regulations;
(b) The Penalty Charge shall be payable not later than 16.00 hours on the Applicable Date subject to the provisions of the Penalty Charge and the 2022 Regulations.
Date of operation: The Order will come into operation on 17th June 2022.

Application to the high court: Anyone who wishes to question the validity of the Order of any provision contained in it on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984 or on the grounds that any requirement of the Act, or any instrument made under it, has not been complied with in relation to the Order, may within six weeks from the date of the making of the Order apply to the High Court for this purpose.
Speed Cushions - Smeaton Close, Colchester
Notice is hereby given under section 90(A-F) of The Highways Act 1980 the Essex County Council has installed 3 pairs of speed cushions on the following lengths of road, in the Borough of Colchester:
Road Description
Smeaton Close From a point approximately 9.3 metres southeast of its junction with Brunel Way.
Smeaton Close From a point approximately 95.7 metres southwest of its junction with Brunel Way.
Smeaton Close From a point approximately 137.5 metres southwest of its junction with Brunel Way
Each cushion is approximately 3 metres in length, approximately 65mm in height, and a gradient of approximately 1 in 8 max. Date of operation: The Speed Cushions will come into operation on 20 June 2022.

Notice is hereby given that the Essex County Council has made the above Order under section 14(1) and 22(c) of the Road Traffic Regulation Act 1984. Effect of the order:
1. To temporarily close the following lengths of road in the
Borough of Colchester: Road Description
Abbeyfield View From its junction with Circular Road South, (Both junctions), south for a distance of approximately Colchester 50 metres.
Berechurch Road, From its junction with Circular Road South, Colchester northeast for a distance of approximately
80 metres to its junction with Circular Road
East.
Circular Road i. From its junction with Berechurch Road, East, Colchester north for a distance of approximately 272 metres. ii. From its junction with Circular Road North/ Flagstaff Road/Napier Road, southeast for a distance of approximately 195 metres. Circular road From its junction with Napier Road & North, Colchester Flagstaff Road, west for a distance of
approximately 705 metres to its junction with Circular Road West. Circular Road From its junction with Berechurch Road, west South, Colchester for a distance of approximately 677 metres
to its junction with Circular Road West. Circular Road i. From its junction with Circular Road North West, Colchester until it meets the junction that leads into the Cavalry Road Estate. ii. From the junction that leads into the Cavalry Road Estate, extending south for a distance of approximately 520 metres until its junction with Circular Road South. Goojerat Road, From its junction with Circular Road west, Colchester west for a distance of approximately
195 metres to its junction with Kensington Road.
Richmond Road, From its junction with Circular Road West, Colchester west for a distance of approximately 50 metres.
Stable road, From its junction with Circular Road North, Colchester northwest for a distance of approximately
70 metres.
Ypres Road, From its junction with Circular Road South, Colchester south for a distance of approximately 50 metres.
2. A temporary 'No Stopping' restriction will be introduced on both sides of carriageway on the above lengths of roads for the duration of the closure to facilitate the event. Signs will be installed indicating when the No Stopping restriction will be in force.
The Essex County Council (Colchester Borough) (Waiting Restriction) (Consolidation) Order 2008 will be temporarily amended to include the temporary 'No Stopping at Any Time' restriction and suspend any existing parking and waiting restrictions on the above lengths of roads only. All other restrictions and exemptions contained in the aforementioned Order and Amendments to that Order shall remain in force. The temporary stopping restrictions are scheduled to commence, 8am on 24 June 2022 to 8pm on 25 June 2022 and the closures are scheduled to commence on 25 June 2022 between the hours of 8am to 8pm and are required for public safety while the 16 Air assault brigade and Colchester Garrison Show 2022 takes place. The Order will come into effect 24 June 2022 and may continue in force for 18 months or until the works have been completed, whichever is the earlier.
(Birch Road, Birch) (Temporary Prohibition of Traffic) Order 2022
Notice is hereby given that the Essex County Council intends, not less than seven days from the date of this notice, to make the above Order under section 14(1) of the Road Traffic Regulation
Act 1984.
Effect of the order: To temporarily close that length of Birch Road, Birch in the Borough of Colchester from a point approximately 200m south west of its junction with Fountain Lane for a distance of approximately 20m in a south westerly direction. The closure is scheduled to commence on 15th July 2022 for 1 day, or where stated on a valid permit (BC1170000000000211046DNO -Openreach). The scheduled dates may vary for these works with appropriate signs showing and/or displayed on one.network. The closure is required for the safety of the public and workforce while pole transfer works are undertaken by Openreach. An alternative route is available via Birch Road, Hardys Green, Maldon Road, Beckingham Hall Road, Fountain Lane and vice versa.
The Order will come into effect on 23rd June 2022 and may continue in force for 18 months or until the works have been completed, whichever is the earlier.
(Brightlingsea Road/Clacton Road Westbound/
Clacton Road Interchange, Colchester) (Temporary Prohibition of Traffic) Order 2022
Notice is hereby given that the Essex County Council intends, not less than seven days from the date of this notice, to make the above Order under section 14(1) of the Road Traffic Regulation
Act 1984.
Effect of the order:
1. To temporarily close that length of Brightlingsea Road, Colchester in the Borough of Colchester, from a point approximately 520m north west of its junction with Brightlingsea Road, Wivenhoe for a distance of approximately 50m in a north westerly direction.
2. To temporarily close that length of Clacton Road Westbound, Colchester in the Borough of Colchester, from a point approximately 1450m west then south west of its junction with Elmstead Road for a distance of approximately 100m
in a westerly direction.
3. To temporarily close that length of Clacton Road Interchange, Colchester in the Borough of Colchester, from a point approximately 430m south west of its junction with Slough Lane for a distance of approximately 40m in a south easterly direction.
These closures are scheduled to commence on 13th July for 1 night (22:00-05:00), or where stated on a valid permit (EP10000011906 - Essex County Council). The scheduled dates may vary for these works with appropriate signs showing and/or displayed on one.network. These closures are required for the

Effect of the order: To temporarily close that length of Chapel Road, Fingringhoe in the Borough of Colchester, from its junction with Rowhedge Road for a distance of approximately 940m in a south westerly direction. Notice is hereby given that the Essex County Council intends, not less than seven days from the date of this notice, to make the above Order under section 14(1) of the Road Traffic Regulation
Act 1984.
Effect of the order: To temporarily close that length of Chitts Hill, West Bergholt in the Borough of Colchester, from its junction with Argents Lane for a distance of approximately 190m in a south easterly direction. The closure is scheduled to commence on 12th July 2022 for 1 day, or where stated on a valid permit (BC008WD5G9T4G01 - Openreach). Notice is hereby given that the Essex County Council has made the above Order under section 14(1) of the Road Traffic Regulation Act 1984.
Effect of the order: To temporarily close that length of Clacton Road, Thorrington in the District of Tendring, from a point approximately 1160m south east of its junction with Station Road for a distance of approximately 205m in a south easterly direction.
