Public Notice Basingstoke And Deane Borough Council Town And Country Planning (General Permitted Development) (England) Order 2015 (As Amended) Notice Of Making Of A Direction Without Immediate Effect Under Article 4(1)

NOTICE is hereby given that Basingstoke and Deane Borough Council ("the Council") has made a direction ("the Direction") under article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) ("the Order"). The Direction applies to land at Basing View, Basingstoke described in Schedule 2 below and as shown on the plan attached to the Direction ("the Land"). The Direction withdraws permitted development rights in respect of development comprised within Class MA of Part 3 of Schedule 2 of the Order. The effect of the Direction is that development of the description set out in Schedule 1 below should not be carried out on the Land, unless planning permission is granted on an application made under Part III of the Town and Country Planning Act 1990 (as amended). The Direction was made by the Council on 25 September 2021 and confirmed on 7 April 2022. The Direction is proposed to come into force on 26 September 2022. A copy of the Direction including the plan detailing the Land affected by the Direction can be viewed electronically on the Council's website: www.basingstoke.gov.uk/A4D2021 or a paper copy is available at the Council Offices, Basingstoke and Deane Borough Council, Civic Offices, London Road, Basingstoke, Hampshire, RG21 4AH during office hours (Monday Thursday 8.30am to 5.00pm, Friday 8.30am 4.30pm) by appointment. Representations on the Article 4 direction may be made in writing between 27 September 2021 and 4pm on 15 November 2021 to the Planning Policy Team at the above address or via email to local.plan@basingstoke.gov.uk SCHEDULE1 Development consisting of a change of use of a building and any land within its curtilage FROM A use falling within Class E (commercial, business and services) of Schedule 2 to the Town and Country Planning (Use Classes) Order 1987 (as amended) TO A use falling within Class C3 (dwellinghouses) of Part 3, paragraph 3 of Schedule 1 to the Town and Country Planning (Use Classes) Order 1987 (as amended) this being development permitted by Class MA of Part 3 of Schedule 2 to the Town and Country Planning (General Permitted Development) (England) (Order) 2015 (as amended) excluding any building or land within its curtilage to which prior approval under Class MA has been granted or treated as granted under Schedule 2 of the Town and Country Planning (General Permitted Development) (England) (Order) 2015 (as amended) prior to the date on which this Direction comes into force in accordance with Article 4(2)(a) of the said Order.
