1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Waltham Forest on 7th April 2022 made the above-mentioned Orders under section 6, 35, 45, 46 and 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended.
2. The general effect of the Orders will be:
(i) to provide and regulate an off-street parking place (car park) called the 'Northwood Tower and Hopson House housing estate car park' to operate 'at any time', comprising of 27 permit parking bays and a permit holder solo motorcycle parking bay operating between 7.30 a.m. and 10.30 p.m. on Mondays to Sundays Inclusive (available to resident permit holders, carers permit holders, visitor permit holders, business permit holders, tradespersons permit holders, essential user permit holders and essential user pool permit holders) (the motorcycle parking bay being only for use by solo motorcycles 'at all times'); and disabled resident permit holder parking places (available to a limited number of disabled resident permit holders and carers permit holders, see paragraph 3(ii) below);
(ii) to provide a ban of waiting 'at any time' by any vehicle throughout the car park other than where the parking bays referred to in subparagraph 2.(i) above would be provided;
(iii) to convert a ML RPZ permit holders parking place in Marlowe opposite Braithwaite House to a parking place reserved for H-NT permit holders only operating 7.30 a.m. and 10.30 p.m. on Mondays to Sundays inclusive;
(iv) to convert a section of Marlowe Road (its southernmost east to west arm) to on-street housing estate road, between Clarkson Crescent and its easternmost extremity, and provide a permit parking zone where vehicles would be prohibited from waiting "at any time" except in signed bays; and
(v) to correct a residential address in an existing order relating to the
Marlowe Road E17 (ML RPZ) on-street restricted parking zone; The Orders would further provide for the issue of permits for certain use in and other terms and conditions of use for the car park.
3. Permits for the use of the parking bays referred to in paragraph 2.(1) to (Iv) of this Notice would be available as follows:
(i) Northwood Tower, No. 71 Marlowe Road E17 (all flats) and Hopson House, Nos. 93 and 95 Vallentin Road E17 to be eligible for 'H-NT' resident permits, carers permits, visitor permits, business permits, tradespersons permits, essential user permits and essential user pool permits (excluding any "car-free property) and 'H-NT' visitor permits; and
(ii) "Northwood Tower, No. 71 Marlowe Road E17 and Hopson House, Nos. 93 and 95 Vallentin Road E17 to be eligible for 'DIS-H-NT'
disabled resident parking permits (note: a total of 16 permits will be allocated for use of the disabled resident permit holder parking places referred to In paragraph 2(i) of this Notice and will be available to eligible disabled residents within the aforementioned properties, as per existing planning agreements). 'Note: Where an agreement has been made with the tenant or owner of a property situated in Northwood Tower and Hopson House under section 106 of the Town and Country Planning Act 1990, or section 16 of the Greater London Council (General Powers) Act 1974, or both, restricting the parking of any motor vehicle; no permits will be granted, or only a limited number of permits would be granted, or as the case may be, only permits for specific users would be granted to the tenant or owner of that property subject to the planning agreement.
4. Regarding the parking bays referred to in paragraph 2(i) of this Notice, any vehicle with a valid permit displaying the letters 'H-NT' may use the 'permit holders only parking bays'; motorcycles with a valid permit displaying the letters 'H-NT' may use the 'motorcycle permit holders' and 'permit holders only parking bays' and any vehicle with a valid permit displaying the letters DIS-H-NT may use the 'disabled resident permit holder bays'.
5. The above measures are necessary to ensure that parking and waiting facilities are maintained for the use of eligible residents of the estates, their visitors, disabled persons and other permit holders agreed by the Council. These measures will also prevent parking and waiting where It could cause an obstruction, particularly to emergency services and refuse collection vehicles.
6. 'H-NT' residents and business permits will be charged on a basis of C02 emissions (or, for older vehicles, engine size) and number of vehicles registered to a household. Residents' visitor permits are obtainable as paperless permits or as scratch-cards at a rate of 70p/hour. Please note that the charges for parking permits were subject to an annual increase on 1 /4/22.
7. Copies of the Orders, which will come into operation from 13th April 2022 and all other relevant documents can be inspected until the expiration of a period of 6 weeks from that date on request by either emailing traffic.scheme@walthamforest.gov.uk or visiting (*by appointment) the Highways and Traffic Management office, Low Hall. 8. Any person desiring to question the validity of either of the Orders or of any provision contained therein on the grounds that It Is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with In relation to the Orders may, within six weeks of the making of the Orders, make application for the purpose to the High Court
