BIOMASS AND ENERGY FROM WASTE GENERATING STATION, TILBURY DOCKS, ESSEX
Notice is given that Tilbury Green Power Limited, Tilbury Docks, Port of Tilbury, Essex RM18 7PU (the "Applicant") has made an application (the "Variation Application") to the Secretary of State for Business Energy and Industrial Strategy (the "Secretary of State") under Section 36C of the Electricity Act 1989 to vary the consent (Ref: 12.04.09.04/266C) granted on 04 February 2021 (the "February 2021 Consent") and the direction under Section 90 of the Town and Country Planning Act 1990 (Section 90 Direction) to construct and operate a biomass and energy from waste generating station at Tilbury Docks, Essex.
The current Section 36 Consent authorises the construction and operation of two generating units having a combined generating capacity of 80 MW. The Variation Application requests the Secretary of State to consent to vary the February 2021 Consent and the Section 90 Direction as follows:
to amend Paragraph 2 of the Section 36 consent and Condition 1 definition of "the Development" in the Section 90 Direction, to increase the electrical capacity to 88 MW
The increase in electricity capacity results mainly from technology improvements providing higher energy conversion efficiency. No increase in annual waste throughput is proposed and no additional impacts on the environment will arise.
The Applicant received a notice under Regulation 4(6) of the Variation Regulations that the Secretary of State considers the variation application to be suitable for publication on 18 February 2022.

Unless otherwise indicated, copies of any objections or representations received will be regarded as public documents and will be copied to the Applicant and Thurrock Council. Any representations received by the Secretary of State will be shared with Thurrock Council and the Applicant with all personal information removed.
Should the Applicant provide any further environmental information to the Secretary of State, the Applicant will publish a notice in accordance with Regulation 26 of the EIA Regulations 2017 stating how that information may be inspected and copies obtained, the address that any objections or representations must be sent to and the date (no earlier than 30 days after the last notice is published) by which any such objections or representations must be submitted. The further environmental information will be made available free of charge on the Application website and at the offices of Thurrock Council.
Pursuant to Regulation 8 of the Variation Regulations the Secretary of State may cause a public inquiry to be held into the Variation Application if it considers it appropriate to do so having considered:
(a) any representations made about the Variation Application to the Secretary of State -
(i) which a relevant planning authority makes within two months of the date on with a copy of the Variation Application was served on it under Regulation 5(2((b) of the Variation Regulations; and
(ii) which any other person makes on or before the date specified in accordance with Regulation 5(5)(b)(iii) of the Variation Regulations, where those representations are not withdrawn; and
(b) all other material considerations.
The Secretary of State may consent to vary the February 2021 Consent or may refuse consent to vary that consent.
