ENVIRONMENT AGENCY WATER RESOURCES ACT 1991

(AS AMENDED BY THE WATER ACT 2003) Notice of application for a licence to obstruct

or impede the flow of an inland water using impounding works The Environment Agency Is applying to the Secretary of State for Environment, Food and Rural Affairs for a licence. The Environment Agency is giving notice of this application, in accordance with Section 37 of the Water Resources Act 1991 and Paragraph 2 of Schedule 2 of the Water Resources (Abstraction and Impounding) Regulations 2006. The application is for a licence to obstruct or impede the flow of the River Foss at National Grid Reference SE 64877 62247, Lilling Farm, North Yorkshire. Water will be obstructed or impeded by means of a flow control structure to prevent downstream flooding during severe flood events. The impounding works would consist of a concrete structure with a permanent open orifice and emergency penstock, which will allow flow to pass unimpeded except for when flood conditions occur. The licence shall be viewed as granted, unless the Secretary of State, either as a result of any representations made about the proposal or otherwise, instructs or asks for an application to be made to them.
