TAKE NOTICE:
Intention to Demolish
We, Westlea Housing Association Limited hereby give you formal notice pursuant to paragraph 13 of Schedule 5 to the Act of our intention to demolish 1,2,3,4,7 and 8 Town Close, Kington St Michael SN14 6JN ("the Premises").
Reasons for Demolition
We intend to demolish the Premises because we intend to redevelop the area.
Proposed Demolition Date
We intend to demolish the Premises by 28 January 2015.
Operation and expiry of the Final Demolition Notice
This notice shall replace the Initial Demolition Notice served on the premises on 31 May 2012.
Westlea Housing Association Limited confirms that condition C as set out in paragraph 14(3) of Schedule 5 of the Act is satisfied. This condition states that the demolition of the Premises does form part of a scheme involving the demolition of other Premises, and one or more of those Premises needs to be acquired by us in order for us to be able to demolish them, and in each case arrangements for their acquisition are in place.
This Notice shall cease to be in force on 28 January 2015 unless the Secretary of State extends the period for which the Notice is in force.
Effect of this Notice
Whilst this Notice is in force, the preserved right to buy does not arise in respect of the Premises. Any existing claim to exercise the preserved right to buy in respect of the Premises ceases to be effective on this Notice coming into force.
Right to compensation
The Housing Act 1985, Section 138 confers a right to compensation in respect of certain expenditure. This means that Section 138 of the Act confers on you a right to compensation in respect of legal and other fees and other professional costs and expenses paid by you in connection with the exercise by you of the preserved right to buy.
We will reimburse your costs and expenses as described in paragraph 1 above if within three months from 28 January 2014, you write to us at Methuen Park, Chippenham, SN14 OGU marking your letter for the attention of Maggie Thompson, claiming an amount of compensation pursuant to Section 138C of the Act and enclosing receipts or other documents showing that you have incurred the expenditure in question.
