Notice of application to vary a consent for an Energy from Waste facility on land at Lostock Works, Griffiths Road, Northwich, Cheshire.
Notice is hereby given that Lostock Sustainable Energy Plant Limited ('LSEP Ltd') - Company Number: 09511491 - having their registered office at AMP Technology Centre Advanced Manufacturing Park, Brunei Way, Catcliffe, Rotherham, England, S60 5WG, has applied to the Secretary of State for Business, Energy and Industrial Strategy ('the Appropriate Authority') to vary their consent for an Energy from Waste facility, known as Lostock Sustainable Energy Plant ('LSEP'), under Section 36C of the Electricity Act 1989 (as amended). The 'Variation Application' also applies to the Appropriate Authority to make consequential amendments to the deemed planning permission (as varied on 10th July 2019) for the LSEP, pursuant to the Appropriate Authority's powers under Section 90 (2ZA) of the Town and Country Planning Act 1990, which direct that the current planning permission for the LSEP be deemed varied.
This Variation Application seeks that the Appropriate Authority exercise their powers under Section 36C of the Electricity Act 1989, to vary the existing consent to enable an increase to the consented annual waste fuel throughput of the LSEP, from 600,000 tonnes per annum ('tpa') to 728,000 tpa. The 'Proposal' would increase the energy recovery of the facility and divert an additional 128,000 tpa of waste from unsustainable alternatives such as landfill disposal or export overseas. The Proposal will not materially impact the facility's approved design, layout, technology, or location, and the LSEP will remain within the consented power generating capacity of 90MW.
An Environmental Impact Assessment Report ('EIAR') and nontechnical summary ('NTS') are submitted in support of the Variation Application. The EIAR describes all likely significant environmental effects in comparison to those for the 'Consented Development' and concludes that the Proposal can be accommodated within the acceptable environmental parameters without the need for additional mitigation. The NTS provides a simplified summary of the findings.
LSEP Ltd has received notice under Regulation 4(6) of the 2013 Variation Regulations that the Secretary of State considers that the Variation Application is suitable for publication on Thursday 4 November 2021.
The Variation Application is accompanied by a plan showing the land to which it relates, together with an EIAR. These documents set out the reasons and need for the Variation Application.

All representations other than from the relevant planning authority can be made until no later than Thursday 2 December 2021.
Representations received by the Appropriate Authority will be handled in compliance with the UK General Data Protection Regulation (UK GDPR). Any representations received by the Appropriate Authority will be regarded as public documents, and will be shared with the relevant local planning authority and LSEP Ltd with all personal information removed.
Should the Applicant provide any further environmental information to the Appropriate Authority, the Applicant will publish a notice in accordance with Regulation 26 of the 2017 EIA Regulations stating how that information may be inspected and copies obtained, the address that any objections or representations must be sent to and the date (no earlier than 30 days after the last notice is published) by which any such objections or representations must be submitted. The further environmental information will be made available free of charge on the application website.
Pursuant to Regulation 8 of the Variation Regulations, the Appropriate Authority may cause a public inquiry to be held into the Variation Application if it considers it appropriate to do so having considered:
(a) any representations made about the Variation Application to the Appropriate Authority -
(i) which a relevant planning authority makes within two months of the date on which a copy of the Variation Application was served on it under Regulation 5(2)(b) of the Variation Regulations; and
(ii) which any other person makes on or before the date specified in accordance with Regulation 5(5)(b)(iii) of the Variation Regulations, where those representations are not withdrawn; and
(b) all other material considerations.
The Appropriate Authority may decide to vary the consent or may refuse to vary that consent.
