Up to 200 Residential Units, Access, Amenity Space and Associated Works including new village shop/ hall
Following the refusal of planning permission for the above application by Cherwell District Council, CALA Homes (Midlands) Limited has sought to appeal the decision.
Minor changes to the scheme have been identified and are summarised below. Relevant plans illustrating the amendments are available on request.
Provision of a footway/cycleway link (suitable for use by emergency vehicles) with the Unnamed Road in the location of the existing vehicular access to South Lodge - Illustrated on Architect's Masterplan (CALA130117 CMP-01 J);
Changes to the proposed site access with Fringford Road, to include the provision of a pedestrian refuge island, bus stop and bus shelter on Fringford Road to the north of the proposed site access; - Illustrated on TPA drawing 1301-30/SK10;
Improvements to the Unnamed Road junction with Fringford Road in the form of a junction build-out - illustrated on TPA drawing 1301-30/SK12;
Provision of a 3m wide combined footway/cycleway facility on the eastern side of Fringford Road between the existing 40mph gateway feature south of the Unnamed Road, and the A4095. -Illustrated on TPA drawing 1301-30/SK07A; and
The promotion of a Speed Order to reduce the speed limit of Fringford Road in the vicinity of the site from 40mph to 30mph.
It is therefore proposed that the Inspector, who is determining the appeal, will be presented with the amendments to consider.
Following advice set out in the Planning Inspectorate Good Practice Advice Note 09 and based on the principles established in the Wheatcroft Case (Bernard Wheatcroft Ltd v SEE [JPL, 1982, P37]), it is appropriate that third parties (i.e. neighbours, statutory and non statutory consultees and other consultees/ objectors) are consulted.
