Amendments to Waiting and Loading Restrictions and On-Street Parking Places in the Borough of Epsom and Ewell
On 26 October 2021 Surrey County Council made, with modifications, "The Surrey County Council (Various Roads in Epsom and Ewell) Amendment of Waiting Loading and Unloading Prohibition and On-Street Parking Places Orders) Order 2018 (Amendment No.5) Order 2021". The purpose and effect of the Order, which will commence on 1 November 2021, will be to make certain amendments to the waiting and parking restrictions in the Borough of Epsom and Ewell under Sections 1(1), 2(1) to (3), 4(2), 32,35,36,45,46,49,51 and 53 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 ("the Act") as follows:-
1. AMEND "The Surrey County Council (Various Roads in Epsom and Ewell) (Revocation and Consolidation of Waiting, Loading and Unloading Prohibition and Restriction) Order 2018" so as to - (a) prohibit the waiting by vehicles in certain lengths of the roads specified in Schedule 1 to this Notice, during the times and on the days specified in the said Schedule provide that the following exemptions shall apply - (i) for loading on and unloading from vehicles; (ii) boarding and alighting from vehicles; (iii) using vehicles for works on or adjoining those lengths of roads specified and the maintenance of those roads and the services in them; (iv) for disabled persons vehicles in accordance with the "Blue Badge" scheme; (b) revoke the existing waiting restrictions in certain lengths of the roads specified in Part I of Schedule 2 to this Notice, during the times and on the days specified in the said Schedule, without replacement.
2. AMEND "The Surrey County Council (Various Roads in Epsom and Ewell) (Consolidation and Revocation of Free Street Parking Places) (Disabled Persons) Order 2018" so as to - (a) Provide such free disabled persons on-street parking places in the lengths of roads specified in Schedule 3 to this Notice, during the times and on the days specified in the said Schedule; (b) provide that certain other vehicles may wait in certain circumstances e.g. to allow persons to board or alight (maximum 2 minutes) to load or unload (maximum 20 minutes), etc; (c) revoke the existing disabled on-street parking places in certain lengths of the roads specified in Part II of Schedule 2 to this Notice, during the times and on the days specified in the said Schedule, without replacement.
3. AMEND "The Surrey County Council (Various Roads in Epsom and Ewell) (Consolidation of Free On-Street Loading Bays and Free On-Street Goods Vehicle Loading Bays) Order 2018" so as to - (a) provide a 24-hour goods' vehicles loading bay in a certain length of A24 High Street, Epsom to operate at anytime; (b) provide that the usual exemptions e.g. Emergency vehicles, vehicles for works on or adjoining those lengths of roads, the maintenance of those roads and the services in them would apply to the aforementioned loading bays referred to above (N.B. the usual exemptions for blue badge holders shall not apply to this restriction).
4. AMEND "The Surrey County Council Various Roads in the Borough of Epsom and Ewell (Consolidation of Permit Holders Only) Order 2018" so as to -
(a) introduce a system of permit parking in the entire length of Highridge Close, Epsom by converting this length of road into an on-street permit holders' only parking place, with the letter identifier "BB" to operate Monday to Friday (inclusive), between 8am and 4pm, with the following provisions - (i) the residents that may be eligible to apply for parking permits will be all residents of Highridge Close, Epsom; (ii) the vehicles which may be left in the parking place, during the hours of operation shall be vehicles displaying a valid parking permit bearing the appropriate identifying letter; (Hi) provide residents' parking permits for residents of the said properties, which will allow them to park in the said on-street permit holders' only parking place during the hours of operation. Such permits, which will be issued by Epsom and Ewell Borough Council, will cost £50 for the first permit and £75 for any subsequent permit and will be valid for a period of twelve months. The charge for a duplicate permit or a change of permit due to the change of vehicle will be £15; (iv) provide that such residents parking permits shall be allocated using the following calculation: the sum of the number of vehicles registered to the place of abode minus the number of off-street parking places for such place of abode; (v) provide for: (1) residents to purchase permits for use by their visitors at a cost of £2 each, which will be valid for one day, subject to a limit of 120 per year; (2) Operational Permits, for use by doctors and nurses, who are required to make visits to residents, which will be free of charge; and (3) Carer's Permits, for carers and community care personnel, who are required to make visits to housebound residents at a cost of £10; which will allow them to park in the said parking place; (vi) provide that vehicles left by specified disabled persons may wait at all times without time limit; (vii) provide that certain other vehicles may wait in certain circumstances e.g. to allow persons to board or alight (maximum 2 minutes) to load or unload (maximum 20 minutes), etc; (viii) provide that outside the hours of operation indicated any vehicle may be left in any of those free on-street parking places for any period without time limit.
(b) introduce a system of permit parking in the entire length of Whitmores Close, Epsom by converting this length of road into an on-street permit holders' only parking place, with the letter identifier "CC" to operate Monday to Friday (inclusive), between 10am and 4pm. The cost and conditions of use will be the same as sub-paragraphs 4(a)(ii), 4(a)(iii 4(a)(iv), 4(a)(v), 4(a)(vi), 4(a)(vii) and 4(a)(viii). All residents of Whitmores Close, Epsom may be eligible to apply for permits;
(c) introduce a system of permit parking in the entire length of Woodcote Park Road, Epsom by converting this length of road into an on-street permit holders' only parking place, with the letter identifier "DD" to operate Monday to Friday (inclusive), between 10am and 4pm. The cost and conditions of use will be the same as sub-paragraphs 4(a)(ii), 4(a)(iii), 4(a)(iv), 4(a)(v), 4(a)(vi), 4(a)(vii) and 4(a)(viii). All residents of Woodcote Park Road, Epsom may be eligible to apply for permits;
(d) include the following properties to be eligible to apply for permits which will allow them to park in the specified Permit Parking Area. The cost and conditions of use will be the same as sub-paragraphs 4(a)(ii), 4(a)(iii), 4(a)(iv), 4(a)(v), 4(a)(vi), 4(a)(vii) and 4(a)(viii) - (i) Permit Parking Area "J": property No. 33 Ashley Road; (ii) Permit Parking Area "Z": property Nos. 91 and 93 Dorking Road; (iii) Permit Parking Area "D": property Nos. 37 and 39 Worple Road; (iv) Permit Parking Area "Y": property Nos. 31 and 38A West Street, 1, 2 and 3 Tudor Close;
(e) (N.B. in the on-street permit holders' only parking places referred to above in sub-paragraphs 4(a), 4(b) and 4(c), no traffic signs relating to such parking place would be marked on the ground or provided on site, other than a sign at the entry/exit points and, if necessary, upright traffic signs at various locations within the parking place).
5. WHERE a new restriction is imposed in this Notice, any existing restrictions on the same length of road have been revoked.
6. MAKE certain drafting amendments to the following Orders which will not affect the operation of the prohibitions and restrictions on the ground - (a) The Surrey County Council (Various Roads in Epsom and Ewell) (Consolidation of Free Street Parking Places and Revocation) Order 2018; (b) The Surrey County Council (Various Roads in Epsom and Ewell) (Consolidation and Revocation of Prohibition of Stepping Outside Schools) Order 2018; (c) The Surrey County Council Hookfield and Lindsay Close Controlled Parking Zone in the Borough of Epsom and Ewell (Consolidation of Waiting Restrictions and On-Street Parking Places) Order 2018.

Additionally, a copy of the made Order may be requested by contacting the Traffic Regulation Orders Team. If you wish to question the validity of the Order, or any provision contained in it, on the grounds that it is not within the powers conferred by the Act, or on the grounds that any requirement of the Act of any instrument made under it, has not been complied with in relation to the Order, you may, within six weeks of the date of the making the Order apply to the High Court for this purpose.
