LOCAL AUTHORITIES (ALCOHOL CONSUMPTION IN DESIGNATED PUBLIC PLACES) REGULATIONS 2007
NOTICE IS HEREBY GIVEN that Bournemouth Borough Council of The Town Hall, Bourne Avenue, Bournemouth, BH2 6DY ("the Council") in exercise of its powers under the Local Authorities (Alcohol Consumption in Designated Public Places) Regulations 2007, has made an order which shall come into effect on 1st July 2014 identifying the whole of the Borough of Bournemouth as a designated public place pursuant to the Criminal Justice and Police Act 2001 (as amended by the Violent Crime Reduction Act 2006).
The Order allows a Police officer, Police Community Support Officer (where accredited under Section 41, section 42 and schedule 5 to the Police Reform Act) and people accredited through a community safety accreditation scheme to control the consumption of alcohol within designated public places. Where anti-social behaviour is present or highly likely, if they believe that someone is consuming alcohol or intends to consume alcohol they can require them to stop or they can they can confiscate the alcohol.
Any person who fails without reasonable excuse to comply with an officer's request under this provision commits an offence and is liable on summary conviction to a fine not exceeding level 2 on the standard scale (currently £500).
If, within the designated area, alcohol is sold under the conditions of a premises license held by the Council or Temporary Events Notice (in accordance with Section 26 of the Violent Crime Reduction Act 2006), this area will not form part of the designated public place while alcohol is being sold or supplied and for a period of 30 minutes thereafter. The areas where the Council holds a license are:
* Bournemouth Town Centre - pedestrianised area.
* Shelley Park
* Winton Recreation Ground
* Alum Chine
* Kings Park
* Meyrick Park Schedule
Land designated by description in the Borough of Bournemouth
All public highways, open spaces and areas the public have access to within the Borough of Bournemouth.
