APPLICATION FOR A HARBOUR REVISION ORDER AND MARINE LICENCE

NOTICE OF APPLICATION FOR A HARBOUR REVISION ORDER AND MARINE LICENCE

NOTICE IS HEREBY GIVEN that Poole Harbour Commissioners ("the applicant") has applied to the Marine Management Organisation ("MMO") for a harbour revision order under section 14 of the Harbours Act 1964 ("the Act") and for a marine licence under Part 4 the Marine and Coastal Access Act 2009. The proposed order would confer on the applicant powers to construct works in 5 phases of development; namely to create a new deep water quay east of the existing Ro-Ro berths, strengthening, extending and deepening the existing conventional quays within the Port and land reclamation to create additional land adjacent to these new and extended quays. Finally, the works will include the reconstruction of the two existing Ro-Ro berths. Any public rights of navigation that are affected by this work are extinguished or varied as necessary to ensure that there is no conflict. The order also encompasses powers to maintain the works by dredging.

The MMO has determined the proposed order relates to a project which falls within Annex I or Annex II of Council Directive 2011/92/EU on the assessment of the effects of certain public and private projects on the environment and is considered a relevant project for the purposes of schedule 3 to the Act. Accordingly, an environmental statement is required and has been submitted with the application.

The MMO does not consider the project is one which is likely to have significant effects on the environment in another EEA state and consequently paragraph 16 of schedule 3 to the Act does not apply.
A copy of the draft order, marine licence application and accompanying documents may be inspected, free of charge, at all reasonable hours until the expiry of the forty-two day period referred to below at Harbour Office, 20 New Quay Road, POOLE BH15 4AF

A copy of the environmental statement may be purchased at that address at a cost of £50.00 for a paper copy and £5.00 for a CD. The draft order and accompanying documents mayalso be viewed on the MMO's website at http://www.marinemanagement.org.uk/ licensing/public_register/harbour.htm.
Copies of the marine licence application may be viewed on line in the Public Register at www.marinemanagement.org.uk/ publicregister.

Any person desiring to make an objection or representation concerning these applications should write to the Inshore Marine Licensing Team, Marine Management Organisation, Lancaster House, Hampshire Court, Newcastle Upon Tyne, NE4 7YH or email to harbourorders@marinemanagement.org.uk. An objection or representation should:
i. be received before the expiry of a period of 42 days starting with the date at the foot of this notice;

ii. be made in writing quoting reference DC9764;

iii. state the grounds of the objection or representation;

iv. indicate who is making the objection or representation; and

v. give an address to which correspondence relating to the objection or representation may be sent.

The MMO will pass to the applicant a copy of any objections and other representations received.
If an objection is duly made and not withdrawn then the MMO may cause an inquiry to be held. Any objections duly made and not withdrawn and any representations duly made will be considered before the MMO makes a determination in respect of the application. Dated: 19 June 2014
