PUBLIC NOTICE

NEW SOUTHGATE CEMETERY AND CREMATORIUM LIMITED

SECTION 3 AND SECTION 4

OF THE NEW SOUTHGATE CEMETERY ACT 2017

NOTICE is hereby given that in order to provide additional space for burial for burial at the New Southgate Cemetery, Brunswick Park Road, New Southgate, London N11 1JJ, New Southgate Cemetery and Crematorium Limited ("the Company"), in exercise of the powers conferred on it by:

1) Section 3 of the New Southgate Cemetery Act 2017 (hereinafter, "the Act"), intend to extinguish the right of burial in graves within Sections H, J, K & L of the Cemetery (some of which are consecrated) (a full list of the grave numbers is contained in the Schedule below) in which the right of burial has not been exercised for 75 years or more from the date of the latest burial in the grave space or, if there has been no burial in the grave space, from the date of the grant of the right of burial in the grave space, and remove memorials in and on those graves, and use the space for other burials; and



2) Section 4 of the Act, intend to disturb human remains in the graves listed in the Schedule below in which the rights of burial have been extinguished as set out above, for the purpose of increasing the space for burials in those graves. Any human remains disturbed will be reinterred in the grave or in another grave in the cemetery, such grave being below the level of the ground and consisting wholly or substantially of earth.



In accordance with section 4(12) of the Act, a faculty granted by the consistory court of the diocese in which the relevant land is situated will be sought where appropriate for the exercise of the powers in section 4.

It is intended that the rights of burial shall be extinguished, and memorials removed on 31 /03/2021 after which work to re-use and increase the space for burial in the graves will be undertaken. Objections

Extinguishment of burial rights and removal of monuments under section 3.

If notice of objection to the extinguishment of a right of burial in any grave space is given to the Company before 31 /03/2021 by the registered owner of the right of burial and that objection is not withdrawn, the right of burial to which that objection relates may not be extinguished under section 3.

If notice of any other objection to the extinguishment of any rights of burial or to the removal of any memorial, and of the ground of any such objection, is given to the Company before 31 /03/2021 and is not withdrawn, any rights or memorial to which the objection relates may not be extinguished or removed without the consent of the Secretary of State.

Disturbance of human remains under section 4

If notice of objection to the proposed disturbance of human remains is given to the Company before 31/03/2021 by the registered owner of the extinguished right of burial or the registered owner of a memorial erected or placed in or on any grave spaces specified in the Schedule or by a relative of the person whose remains are proposed to be disturbed, and that objection is not withdrawn, the Company may not exercise its powers under this section for a period of 25 years from 30/09/2021

Memorials

Any memorial removed by the Company under section 3or 4 of the Act remains the property of the owner but if the owner does not claim it within a period of six months after 31/03/2021 the Company may put the memorial to such use as the Company considers appropriate or the Company may destroy it.

Compensation and arbitration

If a claim for compensation for any right of burial extinguished under section3 is made by the registered owner of the right of burial within six months from the extinguishment of that right the Company will pay the owner a sum representing the value of that right. That sum is to be agreed between the Company and the owner, or in default of agreement, determined by an arbitrator (to be appointed by agreement between the Company and the owner, or in default, by the President of the Royal Institution of Chartered Surveyors).
