THE WEAR VALLEY RAILWAY (TRANSFER) ORDER 2020
NOTICE IS HEREBY GIVEN under section 14(4) of the Transport and Works Act 1992 ("the Act") that the Secretary of State for Transport has determined under section 13(1) of the Act to make, with modifications, the Wear Valley Railway (Transfer) Order 2020 ("the Order"). The Order was applied for by Weardale Railway Limited ("the Applicant"), formerly known as SWINMADCO57 Limited of Vinovium House, Saddler Street, Bishop Auckland, Co. Durham, England, DL14 7BH.
The Order authorises the Applicant to transfer from Weardale Realisations CIC (the Transferor"), formerly known as Weardale Railways CIC, to the Applicant certain statutory provisions and other rights and liabilities relating to the Wear Valley Railway in County Durham. The Order would also authorise the Applicant to sell or lease the rai Iway with the consent of the Secretary of State and makes provision as to the operation of the rai Iway. The Order does not authorise the acquisition of land or any worb powers.
Copies of the Order, once made, may be obtained from the Stationery Office or through booksellers.
The Secretary of State has, pursuant to section 14(1)(a) of the Act, given notice of this determination by way of a decision letter dated 13 October 2020, copies of which may be obtained from the Transport Infrastructure Planning Unit, Department for Transport, Zone 1/14-18, Great Minster House, 33 Horseferry Road, London SW1P4DR. That letter gives the reasons for the determination and the considerations upon which it is based; information about the public participation process; and information regarding the right to challenge the validity of the determination and the procedures for doing so.
