DETERMINATION OF DISCOUNTS FOR EMPTY HOMES
In accordance with the provisions of sections 11 of the Local Government Finance Act 1992 as amended by the Local Government
Act 2003, the Local Government Finance Act 2012 and the Rating (Property in Common Occupation) and Council Tax (Empty Dwellings)
Act 2018 Buckinghamshire Council makes the following determination which will come into force from 1 April 2020.
Properties that are unoccupied and substantially unfurnished will receive a council tax discount (Class C) of 100% for a period of
1 month. For the purpose of determining the last occupation day, any period of less than 12 weeks within which the dwelling concerned
was occupied shall be disregarded.
Properties that are unoccupied and substantially unfurnished and undergoing structural alterations or major repairs to make it habitable
will receive a council tax discount of 50% (Class D) for up to 12 months. For the purpose of determining the last occupation day, any
period of less than 12 weeks within which the dwelling concerned was occupied shall be disregarded.
Second homes (premises which are unoccupied but furnished) will receive a 10% council tax discount.
Long Term Empty properties will be charged the maximum council tax premium as allowed by Regulation:
• From 2020/2021 properties empty for more than 2 years but under 5 years will be charged a 100% premium. This will be in addition
to the council tax charge itself (equivalent to 2 x council tax).
• Properties empty between 5 years and 10 years will be charged a premium of 200%.This will be in addition to the council tax charge
itself (equivalent to 3 x council tax).
• From 2021 onwards properties empty for more than 10 years will be charged a 300% premium. This will be in addition to the council
tax charge itself (equivalent to 4 x council tax). Dated: 20 March 2020
