The Waltham Forest (Charged-For Parking Places) (Amendment No. 24) Order 2019 (FSR)
NOTICE IS HEREBY GIVEN that the Council of the London Borough of Waltham Forest on 12th December 2019 it made the above-mentioned Traffic Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, the general effect of which will be to:
(a) continue indefinitely the provisions of The Waltham Forest (Charged-For Parking Places) (Amendment No. 125) Experimental Order 2018 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) Order (Amendment No. 158) Experimental Order 2018, the effect of which is to provide the 'Cathall North' (CTN) Controlled Parking Zone -including:-
(i) permit holder's parking places (for the use of vehicles in respect of which a 'CTN' permit or other valid permit has been granted), operating Monday to Saturday, 8 am to 6.30 pm, and waiting restrictions, operating either Monday to Saturday, 8 am to 6.30 pm or 'at any time' at road junctions, dropped kerbs and other locations vulnerable to obstruction, in: Clover Close, Cowley Court, Gramer Close, Granleigh Road, Lascelles Close, Lincoln Street, Lynn Road, Marchant Road, Mayville Road, Melford Road, Norman Road, Park Grove Road, Short Road, Southwell Grove Road, Trinity Close, West Street and Woodlands Road (parking places in Clover Close, Cowley Court, Lascelles Close, West Street and part of Norman Road being indicated by the sign "Permit holders parking only past this poinf with no specific parking places marked on the carriageway);
(ii) waiting restrictions, operating Monday to Sunday, 7 am to 10 am, outside Nos. 567-575 High Road, Leytonstone;
(iii) 'pay by phone' parking places, operating (3 hours max. stay, no return 3 hours) either:- Monday to Saturday, 8 am to 1 pm and 2 pm to 6.30 pm in: High Road, Leytonstone (6 locations), Lynn Road, Marchant Road, Trinity Close and West Street; or Monday to Saturday, 10 am to 1 pm and 2 pm to 6.30 pm: outside Nos. 567-575 High Road, Leytonstone; The parking charge for the use of these parking places will be as detailed in item 4 following; and
(iv) formalised disabled persons' ('blue badge') parking places, operating 'at any time' in: Granleigh Road, Lincoln Street, Melford Road, Park Grove Road (3 locations); Short Road (2 locations) and West Street;
The following properties (all E11 streets) will continue to be eligible to apply for 'CTN' permits: all properties in Clover Close, Cowley Court, Gramer Close, Granleigh Road, Lascelles Close, Lincoln Street, Marchant Road, Mayville Road, Melford Road, Norman Road, Park Grove Road, Short Road, Southwell Grove Road, Trinity Close, West Street, and Woodlands Road; Queen Elizabeth Second Jubilee Centre and Leytonstone Leisure Centre in Cathall Road; and Nos. 473 to 645 (odds) High Road, Leytonstone.
(b) continue indefinitely the provisions of The Waltham Forest (Charged-For Parking Places) (Amendment No. 126) Experimental Order 2018 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 159) Experimental Order 2018, the effect of which is to provide the 'Cathall South (CTS) Controlled Parking Zone -including:-
(i) permit holder's parking places (for the use of vehicles in respect of which a 'CTS' permit or other valid permit has been granted), operating Monday to Saturday, 8 am to 6.30 pm, and waiting restrictions, operating either Monday to Saturday, 8 am to 6.30 pm or 'at any time' at road junctions, dropped kerbs and other locations vulnerable to obstruction, in: Anglian Road, Apollo Place, Apple Road, Birch Grove, Cathall Road, Corn Way, Denmark Street, Melon Road, Pear Road, Peppermint Place (part), Orange Grove (all parking places in the roads mentioned above being indicated by the sign "Permit holders parking only past this poinf with no specific parking places marked on the carriageway (except Cathall Road between Nos. 7 and 53 which will have specific permit holder parking places instead);
(ii) pay by phone' (pbyp) parking places, operating:- Monday to Saturday, 8 am to 1 pm and 2 pm to 6.30 pm in: Melon Road - (south side - opposite No. 52); Cathall Road - (north side - opposite the rear of Nos. 17 and 18 Lascelles Close); and Denmark Street (both sides -adjacent the south wall of the public house on LHR);
(iii) removed a pbyp parking place outside Nos. 2 to 8
Cathall Road;
(iv) formalised disabled persons' ('blue badge') parking places, operating 'at any time' in: Apple Road (outside Nos. 5, 6 and 8); Birch Grove (both sides - outside Nos. 7, 44, 47, 96 BHG); Cathall Road (eastern side - outside Nos. 27 and 29 CTL); Corn Way (eastern side - outside No. 47 CNW); Melon Road (northern side - outside Nos. 16/18 MLN); Orange Grove (eastern side - outside No. 36 OG); Peppermint Place (outside Nos. 43 to 47 PP);
The following properties (all E11 streets) will continue to be eligible to apply for 'CTS' permits: all properties Anglian Road, Apollo Place, Apple Road, Birch Grove and Pear Road; Cathall Road - Nos. 2 to 18 (evens only) and 1 to 53 (odds only); Corn Way - Nos. 2 to 30 (evens only) and Nos. 31 to 71 (odds only); High Road Leytonstone (HRL) - Nos. 459 to 461 HRL (odds only and excluding No. 463 HRL); Melon Road - Nos. 1 to 29 (odds only) and Nos. 2 to 52 (evens only); Orange Grove - Nos. 1 to 101 (odds only) and Nos. 20 - 42; Peppermint Place - Nos. 43 to 47 (odds only),
(c) continue indefinitely the provisions of The Waltham Forest (Charged-For Parking Places) (Amendment No. 135) Experimental Order 2018 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 168) Experimental Order 2018 the effect of which is to provide the 'Forest Rising' (FSR) Controlled Parking Zone -including:-
(i) permit holder's parking places (for the use of vehicles in respect of which a 'FSR' permit or other valid permit has been granted), operating 10 a.m. and 4 p.m. on Mondays to Fridays inclusive, and waiting restrictions, operating either Monday to Fridays 10 a.m. and 4 p.m. or 'at any time' at road junctions, dropped kerbs and other locations vulnerable to obstruction, in: Buxton Drive E11, College Place E17, Forest Rise E17, Foresters Drive E17, Morgan Avenue E17, Oakhurst Close E17, Oakhurst Gardens E17, Salters Road E17, The Forest E11, The Risings E17 (all parking places in the roads mentioned above being indicated by the sign "Permit holders parking only past this point" with no specific parking places marked on the carriageway;
(ii) formalised disabled persons' ('blue badge') parking places, operating 'at any time' in:: Salters Road E17 (x1 north-west side - outside No. 29); Forest Rise E17 (x1 west side - outside Nos. 103/105); Oakhurst Gardens (x 2 north side outside Forest School);
The following properties (all E17 streets) will continue to be eligible to apply for 'FSR' permits: all properties Buxton Drive E11 (except Buxton Court); College Place E17 Foresters Drive E17; Morgan Avenue E17; Oakhurst Close E17; Oakhurst Gardens E17; Salters Road E17; The Forest E11; The Risings E17; Oakhurst Court; Woodlands Gardens - Woodford New Road E17 and Forest Rise E17 - Nos. 80 to 122 only (excluding Hainault Court off of Lea Bridge Road);
Nb/allPbyP parking places mentioned in this notice will continue to operate Mondays to Saturdays, between 8am to 1pm and 2pm to 6.30pm (except between Nos. 567 and 575 High Road Leytonstone, where the times of operation will be from 10am - 1pm and 2pm - 6:30pm); and all will have the first 15 minutes parking 'free' or Pay by Phone with a maximum stay of 3 hours and no return within 3 hours. Charges are shown in item 4 below.
Parking permit eligibility and other criteria, along with variations in pricing for certain parking permits based on vehicle emissions will apply on the anniversary/renewal of any existing permit granted for use in the aforementioned CPZ These conditions became effective from 1st April 2019. 2. The Orders will provide that residents' permits, business permits, charity permits {eligible for charities registered with the Charities Commission only), visitors' permits, school staff term-time only permits, residents' foreign vehicle permits, essential user permits, carers permits and tradespersons' permits, may be granted, on payment of the appropriate charge as specified in item 4 following, to a person who is the keeper of a passenger vehicle (having 8 passenger seats or less) or a certain type of goods vehicle or a motor cycle, providing that in the case of -
(a) a residents' permit, they are a resident of a property eligible to purchase permits as listed in a Schedule to this Notice and their vehicle is UK registered to that address;
(b) a foreign vehicles residents' permit, they are a resident of a property eligible to purchase permits as listed in a Schedule to this Notice and their vehicle is registered outside of the UK;
(c) a business permit or charity permit or business visitor's permit, they have a business or charitable organisation in a property eligible to purchase permits as listed in a Schedule to this Notice and that the permit is for a vehicle which is essential to the operation of that business or charity and is used in the purchase and sale of goods or services in connection with that business or charity;
(d) an essential users permit or carers permit, they are either a doctor or carer who has a surgery in or works in the London Borough of Waltham Forest, or employed by or contracted to the Council, or employed by or contracted to a health authority, or employed by the Metropolitan Police (including Police officers), or employed by the London Fire and Civil Defence Authority, or a company that services fire-fighting appliances and for whom the use of a vehicle is essential to the carrying out of their public service duties, or to any carer registered with the Council who is in receipt of a DWP Carers Allowance and who is providing care to a resident living in a CPZ in the London Borough of Waltham Forest ('the borough'), regardless of whether or not that carer resides in the borough, in a street or part of a street specified in items 2(b) to (e) preceding; The Council will, in addition, consider applications for a carers permit on a case by case basis from carers who are not in receipt of a DWP Carers Allowance but who provide care to a resident living in a CPZ in the borough. Medical documents will need to be provided to the Council by the resident receiving care to support such an application. In such a case the carers permit will be charged at the current resident parking permit charge rates.
(e) a school staff term-time only permit, they are a registered member of staff at a primary or secondary school situated in a street or part of a street specified in items 1 (a) to (b) preceding, who has a bona fide reason to drive to that school;
(f) a tradespersons permit, which may be applied for by CPZ residents on the behalf of tradespersons engaged in work at their home address in or near a street or part of a street specified in items 1 (a) to (b) preceding; or
(g) a visitors' permit, if they are a resident of a street or part of a property eligible to purchase permits as listed in any Schedule to this Notice and that such visitors permit is to be used by a bona fide visitor to their home.
3. The charges for permits (per vehicle band, where applicable) for use in the permit holders' parking places referred to in items 1 (a) to (b) preceding are as follows:-

- 1 hour, £0.50p (60 permits per year free to over 60s); Business visitor permit - 1 hour, £1.20; All-Zone Business Visitor's Permit - 1 hour, £1.70; Essential User Permit - 1 month, £45; Essential users pool (multiple vehicles) permit - 12 months, £485; Resident's pool (multiple vehicles) permit - 12 months, 1st vehicle £140, 2nd vehicle £265, 3rd vehicle plus £350; Business pool (multiple vehicles) permit - 12 months, 1st vehicle £645, 2nd vehicle £960, 3rd vehicle plus £1,270; Charity pool (multiple vehicles) permit - 12 months, 1 st vehicle £95, 2nd vehicle £145, 3rd vehicle plus £205; Tradesperson's permit ? single zone - 7 days, £30; Tradesperson's permit -single zone
- 28 days, £100. Services charges for change of VRM or change of address £5, for refunds £10 (refunds under £1 not permitted) and lost or stolen permits, £20. Note: All Residents' visitor Permits will be capped to a maximum of 10 hours on the number of 1 hour visitor permits required to permit all-day visitor parking in any CPZ where the permitted hours are more than 10 hours in duration.
The parking charges for the use of the 'pay by phone' parking places referred to in item 1(a)(iii) and 1(b)(ii) preceding are as follows:-

The Orders will also introduce the following changes which were previously proposed but the introduction of which was delayed until such time as the experimental CPZs within which they were located were brought into permanent effect in Briscoe Close (CHN) E11: addition of a 6.6 metre disabled person's parking place outside No. 20;
Copies of the Orders, which will come into operation on 12th
December 2019 and all other relevant documents can be inspected during normal office hours on Mondays to Fridays inclusive until the expiration of a period of 6 weeks from that date, at: (a) The Information Desk, Town Hall, Forest Road, Walthamstow, E17; and (b) Low Hall, Argall Avenue, London, E10 7AS.
7 Any person desiring to question the validity of either of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks of the making of the Orders, make application for the purpose to the High Court.
