EXPERIMENTAL 'SCHOOL STREET' SCHEME -MANSFIELD ROAD, CHESSINGTON (REF.KINGMAP0031)

THE KINGSTON UPON THAMES (PRESCRIBED ROUTES) (AMENDMENT NO.12) EXPERIMENTAL ORDER 2019

1. NOTICE IS HEREBY GIVEN that the Council of the Royal Borough of Kingston upon Thames on 23rd September 2019 made the above-mentioned Order under section 9ofthe Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985.



2. The general effect of the Order,which will come into force on 7th October 2019, will, on an experimental basis, introduce a'Pedestrian and Cyclist Zone' in Mansfield Road (west of its junction with Coppard Gardens), Field Close, Gibson Close and Tedder Close, Chessington, operating between 8.15 a.m. to 9.15 a.m. and 2.30 p.m. to 3:30 p.m. on Mondays to Fridays (during school termtimes only). The following conditions will apply;



(a) during the operational hours of the scheme, entrytothe zone for motor vehicles will be permitted by means of special dispensation only;

(b)special dispensation (for entering the zone) will be granted by the Council to residents and businesses within the affected zone (as well as to Blue Badge holders whoregister).

3. The Order provides that, subject to the provisions of section 10 of the Road Traffic Regulation Act 1984, the Council'sDirector of Communities, or some person authorised in that behalf by him,may, if it appears to him or that person essential in the interest of the expeditious, convenient and safe movement of traffic or for providing suitable and adequate parking facilities on the highway or for preserving or improving the amenities of the area through which any road affected by theOrder runs, modify or suspend the Order or any provision contained therein.



4. Anyperson desiring to question the validity of the Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any relevant requirements thereof or anyrelevant regulations made thereunder have not been complied with in relation to the Order may, within six weeks from the date on which the Order were made, make application for the purpose to the High Court.



5. The Council will be considering in due course whether the provisions of the experimental Order should be continued in force indefinitelyby means of Order made under sections 6and 124 of the Road Traffic Regulation Act 1984. Anyperson mayobject to the making of an Order for the purpose of such indefinite continuation within aperiod of six months beginning from the date on which the experimental Order came into force, or if an experimental Order is varied or modified,beginning with the date on which such variation or modification came into force.
