THE DOG CONTROL ORDERS (PRESCRIBED OFFENCES AND PENALTIES, ETC.) REGULATIONS (Nl) 2012 (S.R.2012 NO. 114)
CONSULTATION
Notice is hereby given that Fermanagh Omagh District Council intends to make Dog Control Orders pursuant to Part 5 of the Clean Neighbourhoods and Environment (Northern Ireland) Act 2011.
OFFENCES
The Dogs on Leads (Fermanagh Omagh District Council) Order 2019 will make it an offence for any person in charge of a dog to fail to keep the dog on a lead on any land to which this Order applies.
The Dogs on Leads by Direction (Fermanagh Omagh District Council) Order 2019 will make it an offence for any person in charge of a dog to fail to comply with a direction given to them by an authorised officer of the council to put and keep the dog on a lead on land to which this Order applies.
The Dogs Exclusion (Fermanagh Omagh District Council) Order 2019 will make it an offence for any person in charge of a dog at any time to take the dog onto, or permit the dog to enter or to remain on, any land to which the Order applies.
A person who without reasonable excuse breaches any Order shall be guilty of an offence and shall be liable upon summary conviction to a fine not exceeding £1000. A fixed penalty may also be issued for an offence which is set at £80 (maximum). A person shall not have committed an offence if they can prove that the owner, occupier or other person or authority having control of the land has consented (generally or specifically) to the person being on their land.
Nothing in the Order shall apply to a person with a disability (within the meaning of the Disability Discrimination Act 1995) in respect of a dog kept or used by the person wholly or mainly for the purpose of assisting the person to carry out normal day-to-day activities.
LAND TO WHICH THE ORDER IS TO APPLY
It is proposed that The Dogs Exclusion (Fermanagh Omagh District Council) Order 2019 will apply to all land detailed in the Schedule to the Order. That land consists of all play areas, M UGAs, playing fields, running tracks, synthetic pitches, Tennis Courts, Bowling Greens within the Fermanagh Omagh administration boundary.
It is proposed that The Dogs on Leads (Fermanagh Omagh District Council) Order 2018 will apply to all land detailed in the Schedule to the Order. That land consists of all Cemeteries, burial grounds, Leisure Centre Grounds, Public Parks, Grounds around Council Buildings in the Fermanagh Omagh District Council administration boundary.
It is proposed that The Dogs on Leads by Direction (Fermanagh Omagh District Council) Order 2019 will apply to all land within the Fermanagh Omagh District Council administration boundary. It applies to all land which is open to the air and to which the public is entitled or permitted to have access (with or without payment).
