Temporary Closure of Public Footpath 34, Weymouth

DORSET COUNCIL has made an Order under Section 14 [1] of the Road Traffic Regulation Act 1984, as amended bythe Road Traffic [Temporary Restrictions] Act 1991. All pedestrians will be prohibited from proceeding along Public Footpath No 34, Weymouth from grid reference 368458,081686 (point A on the map below), to grid reference 368390 081531 (Point B on the map below), a distance of approximately 170 metres. The order is needed in order to comply with Health and Safety Regulations, which require the provision of safe working areasand to minimise the likelihood of dangerto Highway Users. It will come into operation on the 16 September 2019, for a period of 26 weeks. This order can be extended, with the approval of the Secretary of State for Transport, if necessary. It is anticipated that the works will be completed bythe 01 November 2019. The Order is required to allow the replacement of 2 failing culverts with a single span bridge and associated groundworks to be completed. A locally signed diversion route will be put in place. DORSET COUNCIL intend, not lessthan seven days from the date of this notice, to make an Order under Section 14 [1] of the Road Traffic Regulations Act 1984, as amended. The order is needed in order to comply with Health and Safety Regulations, which require the provision of safe working areas and to minimise the likelihood of danger to Highway Users. The order will come into operation on the 30 September 2019, and will remain in force for 18 months. However it is anticipated that the works will be completed by the 31 January 2020. This Order will enable Dorset Council safe access to replace a section of the harbour wall, and associated works. The effect of the Order is as follows:

[1] To close Custom House Quay, from the junction with the Esplanade to approximately Pilgrims Way, a distance of approximately 100 metres. [2] To revoke the existing one way order on South Parade, between the Esplande and Custom House Quay and impose two way traffic flow to allow for access to be maintained.

[3] To suspend the existing parking bays in South Parade to allow for two way traffic to be maintained for access.

[4] To suspend the existing parking bays on the Esplanade, 3 x parking bays outside Weymouth Baptist Church and 4 x parking bays opposite the junction with South Parade, on the Esplanade. For the duration of the order, a locally signed diversion route will be in place, using; The Esplanade - Pilgrims Way -

Dorset Council proposes to make an Amendment Order to 'The County of Dorset (Various Roads in the District of West Dorset) (Consolidation of Orders made for the Regulation of Traffic) Order 2014' under relevant sections of the Road Traffic Regulation Act 1984 ('the Act') and under Part 6 of the Traffic Management Act 2004 and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with statutory requirement and in compliance with The Local Authorities' Traffic Orders (Procedure) (England and Wales) Regulations 1996.

The effect of the Order will be to prohibit waiting at anytime on specified lengths of Putton Lane and Oldridge Road, Chickerell. Relevant exemptions will apply where appropriate and as necessary in accordance with the provisions of the Order. and will attend at: East Burton Village Hall, Burton Road, Wool, Wareham, Dorset, BH20 6EY On Wednesday 16 October 2019 at 10.00am

To hold a public local inquiry into the Order The effect of the Order, if confirmed without modifications, will be to extinguish the public Footpath running from its junction with East Burton Road, between the properties Southbrook and Marbrouk at SY 83468690, south south west along a grass surfaced path, hedged on both sides, to the boundary of the railway at SY 83428679, continuing south south west across the railway (known as 'Darkies' Crossing) to the edge of a field at SY 83428677, then south south west across the field to its junction with Footpath 13 at SY 8338656 as shown on the Order map. (No recorded width).

Please note that the current definitive map of rights of way does not show the route of Footpath 14 crossing the railway. However, the accompanying definitive statement describes the path from East Burton Road to join Footpath 13, with no mention of a gap. The route of Footpath 14 across the railway has clearly been used, well known and accepted as the legal route.

Report of Local Government and Social Care Ombudsman

The Local Government and Social Care Ombudsman has issued a report following its investigation of a complaint against Dorset County Council (now Dorset Council). The complaint was about an Education & Children's Services matter. The Ombudsman found that there had been fault on the part of the Council and this had caused injustice to the complainant.

Dorset Council has agreed to take action which the Ombudsman regards as providing a satisfactory remedy for the complaint. The Council must now consider the report and tell the Ombudsman within three months (or such longer period asthe Ombudsman may agree) what it proposes to do.

Copies of the report will be available for public inspection during normal office hours at Dorset Council, South Walks House, South Walks Road, Dorchester DT1 1UZ and Dorset Council, County Hall, Colliton Park, Dorchester DT1 1XJ for three weeks starting on 4 September 2019.
