Water Resources Act 1991 (as amended by the
Water Act 2003) Notice of application for a licence to obstruct or impede the flow of an inland water using impounding works. Yorkshire Water Services Limited (YW) has applied to the Environment Agency for a licence. The Environment Agency is giving notice of this application in accordance with Section 37 of the Water Resources Act 1991 and Regulation 6 of the Water Resources (Abstraction and Impounding) Regulations 2006. The application is for a licence to vary the release of water (compensation flow) from Grimwith Reservoir at National Grid Reference SE 06 64 following flow trials carried out by YW since April 2004. The purpose of the flow trials was to secure appropriate flow regimes for the River Dibb and River Wharfe as a result of Water Framework Directive requirements.
The compensation flow from Grimwith Reservoir is currently specified in The Yorkshire Water Authority (Grimwith Reservoir Discharge Order) 1975 ("1975 Order"). YW have applied to revoke the 1975 Order in its entirety. The application will revoke the Section 43 of The Bradford Waterworks Act 1854 ("1854 Act"), which authorised the construction of Grimwith Reservoir. The application will revoke Section 4(1) (Work No.1) of The Yorkshire Water Authority (Grimwith Reservoir) Order 1974, which authorises works to be carried out on Grimwith Reservoir. The current legal requirement is forYWto maintain a minimum compensation flow of up to 272,760 cubic metres per day in the River Dibb. YW are proposing to vary the compensation flows from Grimwith Reservoir as follows:
To release 15,100 m3/d of water from the reservoir from 1st January to 19th April and 1st November to 31st December; 7,800 m3/d from 20th April to 10th May and 12th October to 31st October; 3,800 m3/d from 11th May to 11th October each year.
