Reverter of Sites Act – Extinguishment of Rights Auckland St Peter Sunday School

Whereas:- 1. By a Conveyance/ Deed dated 19th June 1876 between James Thompson Esq (1) and the Vicar and Churchwardens of Auckland St Peter (2) the site (and buildings) of what became known as the Auckland St Peter Sunday School was granted to the Vicar and Churchwardens of Auckland St Peter as trustees pursuant to section 2 of the School Sites Act 1841. 2. The said premises ceased to be used for the purposes of a Sunday School in 2013 and pursuant to section 1 of the Reverter of Sites Act 1987 a trust for sale has arisen in respect of the said premises. Now take notice:-1. The Diocese of Durham proposes either: (i) to make an application to the Secretary of State for Education for the inclusion of the above Sunday School in an Order under section 554 of the Education Act 1996; the purpose of the Order is to allow the assets of the foundation to be used for the benefit of new and continuing schools of the same denomination within the Diocese. The same Order will extinguish the rights of any beneficiary under the trust for sale or (ii) to make an Application to the Charity Commissioners under Section 2 of the Reverter of Sites Act 1987 for the establishment of a Scheme with respect to the property subject to the Trust, which Scheme will extinguish the rights any beneficiary under the Trust and will require that the property be held on trust for such charitable purposes as may be specified in the Order; the charitable purposes specified in the Order shall be as similar in character as the Charity Commissioners think is practicable in all the circumstances to the purposes for which the Trustees held the relevant land before the cesser of use in consequence of which the Trust arose. 2. Any beneficiary who wishes to oppose the extinguishment of the rights should notify his claim in writing to Quality Solicitors Smith Roddam, 56 North Bondgate, Bishop Auckland, County Durham, DL14 7PG no later than 1 September 2015 being at least three months following the publication of this Notice.
